Purpose: Chapter 182-516 WAC is being revised to align state policy with federal law. The agency added language from Section 1917 of the Social Security Act and other sources regarding life estates, promissory notes, loans, trusts, and annuities. The agency is also amending this chapter because Title V, Sec. 5007 the 21st Century Cures Act allows for a person to create his or her own D4A special needs trust. WAC 182-513-1367 Hardship waivers is being revised because it overlaps with Chapter 182-516 WAC as hardship waivers can be used for trusts, annuities, and life states. (WSR 17-24-082)

182-513-1515 Maximum fees and costs
182-513-1520 Procedure to revise award letter after June 15, 1998, but before September 1, 2003
182-513-1525 Procedure for allowing fees and costs from client participation after September 1, 2003
182-513-1530 Maximum guardianship fee and related cost deductions allowed from a client's participation or room or board on or after May 1, 2018 
Purpose: These rules have not been updated since 2003. The agency and the Department of Social and Health Services are amending these rules to: 1) remove outdated sections; 2) increase payments to guardians; 3) address current court orders that pre-date the new rules; and 4) establish a process for court orders entered after the new rules take effect (CR-103P effective date), which is anticipated to be May 1, 2018. Permanent Adoption (CR103P)

182-526-0100 Expedited administrative hearings for urgent health care needs.
182-526-0280 Continuing a hearing when an appellant is an applicant or recipient.
182-526-0290 Reinstating a hearing after an order of default or an order of dismissal.
Purpose: To comply with new federal rules in 42 CFR Part 431, the agency has created a new section WAC 182-526-0100 to allow for expedited administrative hearings for urgent health care needs.  (WSR 17-24-103)

182-550-2301 Hospital and medical criteria requirements for bariatric surgery.
Purpose: The agency has revised the requirements a hospital must meet to perform and be paid for bariatric surgery provided to eligible Apple Health clients. To qualify, a hospital must be accredited by the Metabolic and Bariatric Surgery Accreditation and Quality Improvement Program (MBSAQIP). (WSR 17-24-107)

182-557-0200 Health home program-Eligibility
182-557-0225 Health home services-Methodology for calculating a person's risk score.
Purpose: The agency is revising these sections to fix outdated hyperlinks and to define the criteria by which a person is ineligible to receive health home services. (WSR 17-24-111)
