We plan to send out regular updates covering topics such as:
- How the different types of water users (household users, farmers, private water systems, and more) can prepare for adjudication.

- Details about the adjudication timeline.
To start us off, here’s a brief overview of the adjudication process. This is the same information that Ecology presented at the September 13, 2023, Whatcom Water Week event. We look forward to sharing more with you soon.
Let's talk about adjudication
When it is not clear who has the right to use water, adjudication reviews all water use in a local court process. Everyone needs to submit a claim that explains the water they use.
If you use water from a source other than a public water system, it's important to take part in the adjudication to secure your future right to use water.
What's next for the Nooksack

We notify all water users by certified mail. Spring 2024. The mailing will include instructions and a form for you to return.

You fill out the form about your water use and submit it to the court in person, by mail or online within one year of receipt.

We review the forms and let you know if we need more information.

We write a report about your water use.

The court considers the final report, decides on everyone's water rights, and issues a list in order of priority. If you disagree with the report, you may file an objection with the court.

The Department of Ecology is preparing for the Nooksack water right adjudications over the course of the next biennium. Adjudication is needed to determine how much water is legally available for use and to secure water for long-term planning and instream flow protection.
