Certified Community Residential Change of Ownership
Attention Community Residential Providers:
We are experiencing an increased number of agencies that are transitioning from their current owners to new owners. This may be due to retirement or other business needs. Change of ownership standards are outlined in the Washington Administrative Code. We have had instances of such changes that may not have followed these standards and some instances where the transition time for such change may not have been considered.
The Change of Ownership process requires an application to the Business Analysis and Applications Unit and can take many months to complete.

WAC 388-101-3070
Notice for change of ownership.
The current service provider must notify:
(1) The department in writing sixty days before a change of ownership; and
(2) Clients or their legal representatives in writing thirty days before a change of ownership.
This WAC indicates the amount of notice needed to the department and the clients and legal representatives.
WAC 388-101-3060
Change of ownership.
(1) To apply for a change of ownership, an applicant must submit an application and the required reports and documents to the department when there is a change of:
(a) The business entity ownership; or
(b) The form of legal organization.
(2) When applying for a change of ownership, an applicant may be required to provide any or all items listed in WAC 388-101-3050.
(3) For group homes, applicants must also meet the applicable change of ownership requirements found in:
(a) WAC 388-76-10105 for licensed adult family homes; or
(b) WAC 388-78A-2770 through 388-78A-2787 for licensed assisted living facilities.
(4) If the applicant is not a current service provider, the applicant must apply for initial certification.
This WAC is applicable to a Change of Ownership and not closing of the business.
