Rulemaking notices filed in the Washington State Register 

The following rulemaking notices have been filed with the Office of the Code Reviser and will appear in the Washington State Register.  

Emergency rule adoption (CR-103E)

WSR 19-09-026 on WAC 388-825-091 and 388-837-9010

DDA is amending these rules to correctly reflect level of care and eligibility requirements for state-operated nursing facilities (SONFs) and intermediate care facilities for individuals with intellectual disabilities (ICF/IIDs). This is the third emergency rule filing on these rules. DDA revised the language between the second and third filings in response to community stakeholder feedback. This emergency rule filing is necessary to keep the rule effective until the permanent rulemaking process is complete.  

WSR 19-09-047 on WAC 388-101D-0025 and 388-101D-0120

This is the second emergency rule filing on these rules. This subsequent filing is necessary to keep the emergency rules effective until the permanent rules filed under WSR 19-09-033 (below) are effective.

WSR 19-09-033 on WAC 388-101D-0025 and 388-101D-0120

These amendments remove requirements for residential service providers to schedule within contracted hours and obtain approval of staff coverage schedules. These administrative activities are no longer necessary as part of the tiered rates system established under ESSB 6032 (2018) and approved by the Centers for Medicare and Medicaid Services (CMS).
