Rulemaking notices filed in the Washington State Register 

The following rulemaking notices have been filed with the Office of the Code Reviser and will appear in the Washington State Register.  

Preproposal statement of inquiry (CR-101)

WSR 18-17-154 on WAC 388-828-091, Chapter 388-837 WAC

The department is considering amending WAC 388-828-091 “Am I eligible for residential habilitation center (RHC) services?” and chapter 388-837 WAC “Residential habilitation center (RHC) ICF/IID program”  and other related rules as may be required. 

 

Proposed rulemaking (CR-102)

WSR 18-17-155 on Chapter 388-829C WAC

The department is proposing to amend chapter 388-829C WAC, Companion Homes.

Emergency rulemaking order (CR-103E)

WSR 18-17-105 on WAC 388-825-091 and 388-837-9010

The department is amending WAC 388-825-091 “Am I eligible for residential habilitation center (RHC) services?” and creating WAC 388-837-9010 “Must a client in an ICF/IID be able to benefit from active treatment?” to correctly reflect federal ICF/IID eligibility requirements.  

Effective Date: August 15, 2018

 

Rulemaking order (CR-103P)

WSR 18-17-028 on WAC 388-823-0025 and 388-823-0050

The department amended WAC 388-823-0025 and WAC 388-823-0050 to: simplify the application process for potential clients, including children receiving foster care and dependents of military service members; align requirements with the Health Care Authority’s rules under Title 182 WAC; amend who can request a DDA eligibility determination; and clarify who is considered a Washington state resident.

Effective Date: September 6, 2018
