Dear HR Directors:
On January 15th Governor Youngkin signed Executive Directive 2 - ENSURING PRIVACY PROTECTIONS AND INDIVIDUAL RIGHTS OF EXECUTIVE BRANCH EMPLOYEES. This Directive rescinds Executive Directive 18 (2021).
Today we want to ensure your awareness of the Directive and of actions or items that require your immediate attention.
- Executive Branch employees are no longer required to be vaccinated, to undergo mandatory COVID-19 testing, or to disclose their vaccination status as a condition of their employment.
- Job postings must exclude references to a COVID-19 vaccine/testing mandate.
- New employee onboarding materials must be updated to exclude the disclosure of vaccination status and any information pertaining to the former mandate.
- The revised DHRM Policy Guide – Policy 4.52 Public Health Emergency Leave published on January 10, 2022 remains in effect.
- The Directive specifically includes Institutions of Higher Education and Authorities established within the Executive Branch by the Code of Virginia or designated under a Secretariat in the Code of Virginia.
- The Directive does not restrict agencies from instituting COVID-19 screening protocols that may be necessary to mitigate the spread of COVID-19, consistent with the policies established by the Department of Human Resource Management. We are in the process of refreshing previous policy guides related to this so that they are consistent with the Directive.
- Agencies should continue to comply with the Permanent Standard for Infectious Disease Prevention of the SARS-CoV-2 Virus That Causes COVID-19 and should direct questions to the Virginia Department of Labor and Industry.
- Any agency that determines that a federal requirement applies to any of its offices or programs that is inconsistent with the provisions of this Directive must notify their respective Secretary or the Governor’s Chief of Staff, following consultation with the Office of the Attorney General.
