Purpose: To provide guidance to the Department of Veterans Affairs (VA) acquisition workforce regarding the U.S. Department of Labor, Office of Federal Contract Compliance Programs (OFCCP), National Interest Exemption (NIE), for contracts awarded to support COVID-19.
Effective Date: March 17, 2020 to June 17, 2020.
Affected FAR Parts: FAR 52.222-26, 52.222-35, and 52.222-36.
Applicability: All VA contracting activities supporting COVID-19.
Action Required: These exemptions are granted by OFCCP. For the duration of the exemption period, new, covered Federal contracts supporting COVID-19 should contain language exempting the contractor from having to develop written affirmative action programs required by Executive Order 11246, as amended; the Vietnam Era Veterans’ Readjustment Assistance Act, as amended; and Section 503 of the Rehabilitation Act of 1973, as amended. Specifically, contracting officers shall modify FAR clauses 52.222-25, 52.222-35 and/or 52.222-36, as shown in the OFCCP memo.
