CWE Success Story: Darius Zamani, New England Healthy Hearing

By: Dawn LaRochelle
Project Manager – COVID Business Recovery Central MA

Darius Zamani contacted CWE-Central MA on August 4, 2020 for assistance with his EIDL loan application. He was approved for a loan in the amount of $21,900 ($1,000 of which would be provided as an advance) at the end of May, but he wanted to be reconsidered for additional funds.

On May 28, 2020, Darius spoke by phone with an SBA representative whose name and agent number he did not recall. This representative told Darius not to sign the closing documents for the first authorized loan agreement ($21,900), or he would not be able to obtain any additional funds. The agent confirmed to Darius that the two-month deadline for signing meant that he had until July 28, 2020 to sign the forms, and that the SBA would not withdraw his application prior to July 28th.

Darius never heard back from the reconsideration team about his request for a loan increase. On July 27, 2020, however, he received a letter from the SBA rescinding the first authorized loan agreement ($21,900) due to “inactivity.” Darius then spoke by phone to Agent #2416, a Tier 2 SBA representative.  Agent #2416 reached out to her supervisor about Darius’s case, told Darius she put some notes in his file, and encouraged Darius to email SBA’s Disaster Customer Service about his situation. Darius followed the agent’s advice and emailed Disaster Customer Service that same day. He never heard back from them.

On July 29, 2020, Darius spoke by phone to SBA Agent# 8471. This agent told him to email the same information he had sent to Disaster Customer Service to the reconsideration team. Darius did so and received an automated reply (“Thank you for contacting the PDC reconsideration team. Your request has been received and will be processed in the order it was received."). He did not hear anything further from the reconsideration team.

On August 7, 2020, I had a telephone meeting with Darius. I walked him through the EIDL appeals process and gave him guidance about the kind of information to include in his appeals letter and the way in which he should organize that information. I also gave him guidance about tone – he was, understandably, angry and frustrated, but I wanted him to write in a neutral, factual, and respectful manner. After talking with me, Darius submitted a formal letter of appeal to the SBA by both e-mail and fax. The next day (August 8, 2020), Darius heard back from the SBA. They reinstated the original loan contract ($21,900) for him to sign and deposited the money into his account shortly thereafter. They also gave him instructions on how to request a loan increase in the future.
