Do you know about the PPP Safe HarborWe encourage you to read about it!

The recently published FAQ 46 provides a ‘safe harbor’ when getting a PPP loan.

  • Any borrower receiving a loan under 2 million dollars will be deemed to have requested the loan in good faith.
  • The FAQ goes on to say, for any PPP loan where the borrower did NOT act in good faith (even if over $2M).  “If the borrower repays the loan … SBA will not pursue administrative enforcement or referrals to other agencies …”

The details are below, and you should read it for yourself here.

Question #46: How will SBA review borrowers’ required good-faith certification concerning the necessity of their loan request?

SBA has determined that this safe harbor is appropriate because borrowers with loans below this threshold are generally less likely to have had access to adequate sources of liquidity in the current economic environment than borrowers that obtained larger loans. This safe harbor will also promote economic certainty as PPP borrowers with more limited resources endeavor to retain and rehire employees....READ MORE HERE
