JUDGES ANNOUNCE ROYALTY RATES AND TERMS FOR SATELLITE AUDIO RADIO SERVICES (SDARS) AND PREEXISTING SUBSCRIPTION SERVICES (PSS) 

The Copyright Royalty Judges issued their Initial Determination of Royalty Rates and Terms for SDARS and PSS on December 14, 2017. The Judges have determined that for the period January 1, 2018, through December 31, 2022, SDARS shall pay royalties aggregated for the statutory licenses under sections 112 and 114 of the Copyright Act at the rate of 15.5 percent of Gross Revenues, as that term is described in the accompanying SDARS regulations. During the same rate period, PSS shall pay for the same licenses aggregate royalties of 7.5 percent of Gross Revenues, as that term is described for PSS.

The text of the Initial Determination is RESTRICTED to participants bound by the Judges’ Protective Order. After appropriate redaction of sensitive, confidential information, the Judges will disseminate and post a PUBLIC version of the Initial Determination and the final regulations.

Publication of a Final Determination will occur in due course after the Register of Copyrights completes a review for legal error and the Librarian of Congress approves the Final Determination. For details, click here.
