News Update: The United States and Brazil signed a new Protocol relating to Trade Rules and Transparency, updating the 2011 Agreement on Trade and Economic Cooperation (ATEC) with three new annexes comprising state-of-the-art provisions on Customs Administration and Trade Facilitation, Good Regulatory Practices, and Anticorruption. The agreement addresses several fundamental areas that are key to reducing non-tariff barriers to trade by improving the efficiency and transparency of customs and border procedures; ensuring regulations are developed in a consistent, transparent manner with stakeholder input; and ensuring that Brazil implements robust anti-corruption practices. News Update: The Government of Brazil has changed the requirements for bidding on public procurements so that foreign companies are now able to directly participate in Brazil's government tenders without needing to establish a local representative beforehand. Did You Know? Brazil updated its Ex Tarifario import tax incentive program in 2019 to reduce import taxes and facilitate trade for specific goods not produced domestically in Brazil. Two categories of imports are covered under the program: capital goods and IT equipment. The Brazilian government maintains an updated list of goods covered under the program but importers and local company representatives in Brazil are also welcome to submit petitions to the Ministry of the Economy to have their specific products analyzed and approved under the program. The average approval time for a request is between 60-90 days. If your company is looking to export to Brazil in these sectors, our team can provide guidance on this process which may help make your products more competitive in the Brazilian market. The U.S. Department of Commerce, International Trade Administration, in partnership with the U.S. Department of State, is organizing a trade mission to the Caribbean region that will include the Trade Americas – Business Opportunities in the Caribbean Region Conference in Bridgetown, Barbados on May 23-28, 2021.
The goal of the mission is to help participating U.S. companies find potential partners, buyers, agents, distributors, and joint venture partners in Barbados/Eastern Caribbean, Dominican Republic, Guyana, Haiti, Jamaica, Suriname, The Bahamas, and Trinidad and Tobago, laying the foundation for successful long-term ventures to take advantage of market opportunities in the Caribbean region. During the mission, the delegation will have access to US&FCS commercial officers, commercial specialists, and Department of State economic/commercial officers from the markets in the region.

Mexico recently made important changes to the application of labeling requirements. On October 1, 2020, the Mexican Government published in its Official Gazette an amendment to Annex 2.4.1 (known as the “NOM Annex”), which identifies the HS codes of imported products subject to compliance with technical regulations (Normas Oficiales Mexicanas; NOMs). The key change is the elimination of exemptions to the requirement to comply with labeling measures. Many companies must now label products where they were not previously required to do so.

Argentina: Feasibility Study: Salta ICT Modernization (Deadline: November 10) The Salta Municipal Government (the “Grantee) invites submission of qualifications and proposal data (collectively referred to as the “Proposal”) from interested U.S. firms that are qualified on the basis of experience and capability to execute a feasibility study (the “Feasibility Study”) to support the expansion of broadband, data center, and related smart city infrastructure in the Argentine city of Salta.
Ecuador: Technical Assistance National Grid Control Center Modernization Project (Deadline: November 20) The National Electricity Operator (Operador Nacional de Electricidad, CENACE) (the “Grantee) invites submission of qualifications and proposal data (collectively referred to as the “Proposal”) from interested U.S. firms that are qualified on the basis of experience and capability to execute technical assistance (the “Technical Assistance”) to assess control center upgrades that would enhance the real-time management of Ecuador’s national electricity grid and improve the stability and reliability of the country’s power supply network.
Brazil: Technical Assistance: Banpara Digital Modernization Project (Deadline: November 27) Banco do Estado do Pará (Banpará) is the state bank for the State of Pará, located in northern Brazil. Banpará plans to open 31 new branches by the end of 2021. As such, the bank is in the process of modernizing its IT infrastructure to support this expansion. The Technical Assistance would develop a digital implementation strategy to fully automate Banpará’s products and services, including deposits, loans, credit lines, and internal administrative processes such as payroll, training, and human resource management, as well as the storage of all transactions in an integrated database.
Mexico: Feasibility Study: Micro-Scale LNG Plants (Deadline: December 09) Enestas, S.A. de C.V. (the “Grantee”) invites submissions of qualifications and proposal data (collectively referred to as the “Proposal”) from interested U.S. firms that are qualified on the basis of experience and capability to execute a feasibility study (the “Feasibility Study”) to build and operate micro-scale liquefied natural gas (“LNG”) plants in Mexico.
Ecuador: Technical Assistance: Equatorial Telecom Broadband Network (Deadline: December 15) The technical assistance would enable Equatorial Telecom to expand its fiber optic network, identify prospective investment partners and develop a business model for operating the network.

Panama trade lead: The Panama Canal Authority RFQ The Panama Canal Authority published Tender No. 186071 for the pre-qualification of potential bidders for the engineering, design and construction of a new water management system that will guarantee and adequate water supply for both Canal operations and local consumption for the next 50 years. The project is estimated at USD$ 1.7 billion.
This will be an Engineering, Procurement, Construction (EPC) tender. The RFQ is to short list five firms by the end of November 2020, who will then have to submit comprehensive RFP proposals by August 2021. The contract will be awarded in September 2021, which will enable the winner to start construction in the beginning of Panama’s dry season in January 2022. ACP is doing its own financing, and may consider bonds.
