Issue:  New Supplemental Proof of Claim Form (B 4100S)

On December 27, 2020, the Consolidated Appropriations Act created a new section 501(f) in the Bankruptcy Code.  This new section permits an "eligible creditor" to file a supplemental proof of claim for a CARES Act forbearance claim in a Chapter 13 case.

The federal judiciary developed a new form to file a supplemental proof of claim under the new (temporary) law.  The new form will sunset with the new (temporary) law on December 27, 2021.  The new form is attached and available for download on the US Courts bankruptcy forms page at www.uscourts.gov.
