CDC and FDA Release NYTS Findings on Youth Use of All Tobacco Products
On Nov. 10, CDC and FDA released results on youth tobacco product use from the 2022 National Youth Tobacco Survey (NYTS). Findings show that in 2022, more than 1 in 10 middle and high school students (3.08 million) had used a tobacco product during the past 30 days—including 16.5% of high school and 4.5% of middle school students.
Additionally, on Oct. 6, CDC and FDA released federal data from the 2022 National Youth Tobacco Survey (NYTS) on e-cigarette use among U.S. youth. The findings, published in Morbidity & Mortality Weekly Report, show that youth use of e-cigarettes remains high, with 2.5 million (9.4%) of the nation’s middle and high school students reporting current e-cigarette use.

Designing and Conducting Studies for Tobacco Applications
On August 23, FDA issued a final guidance, “Tobacco Products: Principles for Designing and Conducting Tobacco Product Perception and Intention Studies.”
This guidance is intended to help applicants design and conduct tobacco product perception and intention (TPPI) studies that may be submitted as part of a modified risk tobacco product (MRTP) application, a premarket tobacco product application (PMTA), or a substantial equivalence report (SE Report). TPPI studies can be used to assess, among other things, individuals’ perceptions of tobacco products, understanding of tobacco product information (e.g., labeling, modified risk information), and intentions to use tobacco products. These studies provide critical information during the review of product applications and this guidance provides recommendations on how to perform these studies.
FDA Issues Warning Letters to Manufacturers
- On Nov. 16, FDA issued warning letters to five firms for the unauthorized marketing of 15 different e-cigarette products. Each e-cigarette product is packaged to look like toys, food, or cartoon characters and is likely to promote use by youth. None of the manufacturers submitted a premarket application for any of the unauthorized products.
- On Aug. 18, FDA issued a warning letter for marketing illegal flavored nicotine gummies—the first warning letter for this type of product. These types of gummies are of particular public concern because of their resemblance to kid-friendly food or candy products and the potential to cause severe nicotine toxicity or even death among young children.
- FDA remains vigilant in overseeing the market and will continue to use our compliance and enforcement resources to curb the unlawful marketing of non-tobacco nicotine (NTN) products. As of Oct. 31, FDA has issued a total of over 60 warning letters to manufacturers, including brands popular among youth such as Puff Bar.
