Pausing the implementation and enforcement of Executive Order 14043

Dear FAA Colleagues,

On January 21, 2022, a federal judge issued a preliminary, nationwide injunction pausing the implementation and enforcement of Executive Order 14043 (Requiring Coronavirus Disease 2019 Vaccination for Federal Employees). Following guidance from the Safer Federal Workforce Task Force, the FAA will take no further actions at this time to implement or enforce the COVID-19 vaccination requirement pursuant to Executive Order 14043.

At this time, unvaccinated employees are not required to make a request for an exception to Executive Order 14043 or provide any further supporting documentation in support of an existing request. The Agency will not process existing requests for exceptions or take disciplinary actions related to the enforcement of Executive Order 14043 while the injunction is in place.

However, the preliminary injunction does not apply to other Federal agency safety protocols. This means:

  • FAA is still gathering vaccination status information using attest.faa.gov.
  • All protocols related to masking, physical distancing, travel, testing, and quarantine, remain in effect.  
  • Additional testing requirements are being developed that will require employees who did not attest and provide proof of vaccination, or request a reasonable accommodation, to comply with routine testing requirements.
