Dear Educators and Stakeholders:
Today, the Department published correspondence between the Office for Civil Rights and the Office of the General Counsel addressing the U.S. Supreme Court’s decision in Bostock v. Clayton County, Ga., 140 S.Ct. 1731(2020). Specifically, the Office of the General Counsel, in a Question & Answer format, has offered insight into how Bostock affects OCR’s enforcement of Title IX with respect to discrimination on the basis of homosexuality or transgender status. The correspondence is available here.
Schools that receive federal funds from the Department of Education have a duty to comply with Title IX, including its application to discrimination on the basis of homosexuality or transgender status.
