The U.S. Department of Transportation (USDOT) has released updated frequently asked questions regarding the implementation of the Disadvantaged Business Enterprise (DBE) Interim Final Rule issued on October 3, 2025.
The Interim Final Rule ensures that USDOT operates its DBE and Airport Concession Disadvantaged Business Enterprise (ACDBE) programs in a nondiscriminatory fashion and in line with law and the U.S. Constitution. The Interim Final Rule removes race- and sex-based presumptions of social and economic disadvantage that violate the U.S. Constitution.
Created over 40 years ago, the Department's DBE and ACDBE programs are small business initiatives intended to level the playing field for businesses seeking to participate in federally assisted contracts and in airport concessions.
