On April 24, 2024, the U.S. Department of Justice (DOJ) issued a final rule in the Federal Register under Title II of the Americans with Disabilities Act (ADA) to improve web and mobile application (app) access for people with disabilities. Title II applies to State and local governments, including transit agencies. Transit agencies are classified as “special district government” entities under this rule and will have three years to comply.
The rule clarifies how covered entities must meet their existing ADA obligations as more of their activities move into digital space. It will ensure that people with disabilities can better access important programs and activities, including transportation information, through web content and mobile apps.
This rule adopts an internationally recognized accessibility standard for web access, the Web Content Accessibility Guidelines (WCAG) 2.1, as the technical standard for web content and mobile app accessibility under Title II of the ADA. WCAG 2.1 is a set of guidelines that say what is needed for web accessibility, such as requirements for captions for videos. WCAG is developed by the World Wide Web Consortium (W3C), an industry standard-setting organization.
