EDC-7 Rethinking DBE for Design-Build Spotlight
The U.S. Department of Transportation's (USDOT) Disadvantaged Business Enterprise (DBE) Program ensures that opportunities to participate in Federally assisted contracts for highway, transit, and aviation projects are made available for small business concerns owned and controlled by socially and economically disadvantaged individuals.
As States, or other project sponsors, increase their use of the design-build (DB) project delivery method, traditional approaches to DBE participation prove challenging. This FHWA Every Day Counts (EDC) Innovation, Rethinking DBE for DB, provides tools and practices to modify DBE commitment processes to align with the DB environment and improve DBE participation on these often large and high-profile projects.

Benefits
States, DBEs, and DB teams can benefit in several ways from using open-ended performance plans (OEPPs) and other available tools for successful implementation of the program and equitable DBE opportunities in DB contracting.

Enhanced Opportunities. DBE participation can be increased on DB projects by providing a wider variety of work types throughout the life of the project.

Flexibility. DB teams will have more options to plan and execute DBE participation throughout the project.

Reduced Risk. OEPPs can provide better levels of certainty and mitigate risk for States, DB teams, and DBEs.

Efficiency. Increased participation reduces the need for resource-intensive good faith effort reviews and other associated administrative actions.
