This guidance supersedes the Update on Termination of Temporary Protected Status for Ethiopia message posted on Aug. 6, 2026. 

Alert: After reviewing country conditions and consulting with the appropriate U.S. government agencies, former Secretary of Homeland Security Kristi Noem determined that Ethiopia no longer met the conditions for its designation for Temporary Protected Status (TPS).  See Termination of the Designation of Ethiopia for Temporary Protected Status, 90 Fed. Reg 58028 (Dec. 15, 2025).  On June 25, 2026, the U.S. Supreme Court issued a favorable decision in a similar case concerning TPS terminations. Mullin v. Doe, 609 U.S. ____ (2026). The Ethiopia TPS designation is terminated, effective August 18, 2026. 

What this means for Forms I-766, Employment Authorization Documents (EADs): 

Forms I-766, Employment Authorization Document, (EADs) with category A12 or C19 issued to TPS Ethiopia beneficiaries are no longer valid.  Employers must reverify TPS Ethiopia beneficiaries who presented these EADs and cannot continue employing a person who does not provide proof of current employment authorization.
