This guidance supersedes the Update on Termination of Temporary Protected Status for Burma message posted on Aug. 3, 2026.

After reviewing country conditions and consulting with the appropriate U.S. government agencies, former Secretary of Homeland Security Kristi Noem determined that Burma (Myanmar) no longer met the conditions for its designation for Temporary Protected Status (TPS). See Termination of the Designation of Burma (Myanmar) for Temporary Protected Status, 90 Fed. Reg 53378 (Nov. 25, 2025).  On June 25, 2026, the U.S. Supreme Court issued a favorable decision in a similar case concerning TPS terminations. Mullin v. Doe, 609 U.S. ____ (2026). The Burma TPS designation is terminated, effective Aug. 7, 2026.

What this means for Forms I-766, Employment Authorization Documents (EADs):

Forms I-766, Employment Authorization Document, (EADs) with category A12 or C19 issued to TPS Burma beneficiaries are no longer valid.  Employers must reverify TPS Burma beneficiaries who presented these EADs and cannot continue employing a person who does not provide proof of current employment authorization.
