This guidance supersedes the Update on Termination of Temporary Protected Status for Yemen message posted on July 17, 2026. 

After reviewing country conditions and consulting with the appropriate U.S. government agencies, former Secretary of Homeland Security Kristi Noem determined that Yemen no longer meets the conditions for its designation for Temporary Protected Status (TPS). See Termination of the Designation of Yemen for Temporary Protected Status, 91 Fed. Reg 10402 (March 3, 2026). On June 25, 2026, the U.S. Supreme Court issued a favorable decision concerning TPS terminations. Mullin v. Doe, 609 U.S. ____ (2026).  The Yemen TPS designation is terminated, effective July 20, 2026. 

Forms I-766, Employment Authorization Document, (EADs) with category A12 or C19 issued to TPS Yemen beneficiaries are no longer valid.  Employers must reverify TPS Yemen beneficiaries who presented these EADs and cannot continue employing a person who does not provide proof of current employment authorization.
