Listening Session: Form I-140, Immigrant Petition for Alien Workers

U.S. Citizenship and Immigration Services (USCIS) invites you to participate in a listening session on Tuesday, Dec. 14, 2021, from 2 to 3:30 p.m. Eastern. The listening session is for stakeholders to provide feedback on modernizing and simplifying regulations governing Form I-140 adjudications. This is the first in a series of listening sessions that USCIS will host in the coming months to seek input on business and foreign worker-related policy considerations. USCIS is committed to public engagement and sessions such as these provide us with valuable feedback as we work to improve our programs.
Topics of interest and questions for consideration: While USCIS is interested in overall feedback regarding the I-140 immigrant visa program, we would appreciate feedback on the following topics:
Evidence
- Are there evidentiary requirements that are duplicative, burdensome, or confusing?
Definitions
- Are there terms used in DHS I-140 regulations that lack definitions and, if so, how should USCIS define them?
- For example, should USCIS define the term “sustained” in reference to the acclaim required for extraordinary ability? If so, how should USCIS define that term?
- For multinational executives and managers, should USCIS define “professional” in reference to those a manager must supervise and, if so, how?
Extraordinary Ability
- USCIS is considering modernizing the extraordinary ability criteria to account for online media coverage and recognition as well as significant capital investments, such as those from venture capital firms. Are there other types of modern achievements and recognition that the regulations should consider?
National Interest Waivers
- Should USCIS consider other factors beyond those discussed in Matter of Dhanasar when determining whether it is in the national interest to waive the job offer, and thus the labor certification requirement?
Program Integrity
- What policies, procedures, or new requirements could USCIS implement to improve I-140 program integrity?
