RETIREES UNDER THE NATIONAL DEFENSE AUTHORIZATION ACT (NDAA)
A. Reemployment of Civilian Retirees Under the National Defense
Authorization Act (NDAA), COMDTINST 12333.2
1. This ACN announces the promulgation of REF (A). REF (A) is a
new CG policy which authorizes the U.S. Coast Guard to temporarily
reemploy annuitants (rehire retired Federal employees) without a
salary offset until the expiration date of 31 December 2024.
2. A rehired annuitant is an individual who returns to work for
the federal government after their retirement from federal service.
Without an approved waiver, the Office of Personnel Management (OPM)
reduces a rehired annuitant's federal annuity by the amount of
his/her retirement annuity.
3. The COMDTINST authorizes the Director of Civilian Human
Resources, Diversity, and Leadership (CG-12) to approve requests by
supervisors to waive the salary reduction. If the request is
approved, a rehired annuitant can receive both his/her annuity and
salary without a reduction.
4. Requests from supervisors must meet at least one of the
following conditions:
   a. Fulfills functions critical to the mission of the Coast Guard;
   b. Assists in the implementation or oversight of the American
Recovery and Reinvestment Act of 2009 (Public Law 111-5) or the
Troubled Asset Relief Program under Title I of the Emergency
Economic Stabilization Act of 2008 (12 U.S.C. 5201 et seq.);
   c. Assists in the development, management, or oversight of
agency procurement actions;
   d. Assists the Inspector General for the agency in the
performance of the mission of that Inspector General;
   e. Promotes appropriate training or mentoring programs of
employees;
   f. Assists in the recruitment or retention of employees; or
   g. Responds to an emergency involving a direct threat to life
or property or other unusual circumstances.
5. Other limitations apply.
   a. Reemployed annuitants hired under NDAA cannot serve more
than 520 hours during the period ending six months after
retirement; more than 1,040 hours during any 12-month period; or
more than a total of 3,120 hours, a lifetime limit. Both the
supervisor and the employee must monitor and record the hours
worked under this authority to ensure the limits are not exceeded.
   b. Appointments are made in increments of one year or less.
Appointments may be extended up to one additional year (24 months).
If employment totals are less than 1040 hours in a 12-month period,
then appointments can be extended beyond 24 months up to a
maximum limit of three years.
6. The total number of reemployed annuitants appointed under the
2020 NDAA is limited to one percent of the Coast Guard full-time
workforce, approximately 82.

8. Annuitants rehired under the NDAA authority are required to
submit CG form 12352B - NDAA Request/Condition of Employment.
9. Released by Ms. Michelle Godfrey, Director of Civilian Human
