SUBJ: GUIDANCE FOR REQUESTING RESERVE OFFICER RETIREMENT

B. ACN 056/20, Update to Reserve Officer Retirement Policy Regarding Highest Grade Held
1. ACN 056/20 announced immediate changes to REF(A) regarding reserve officer retirement policy.
In alignment with 10 USC §1370, Reserve commissioned officers in a grade above lieutenant commander, who voluntarily transfer to the Retired Reserve, are entitled to placement on the retired list in the highest grade satisfactorily held for not less than three years in the Armed Force in which they are serving on the date of transfer. Reserve commissioned officers in a grade lieutenant commander or below, who voluntarily transfer to the Retired Reserve, are entitled to placement on the retired list in the highest grade satisfactorily held for not less than six months in the Armed Force in which they are serving on the date of transfer.
2. 10 USC §1370 is not a new law, however, REF(A) has not accurately matched this requirement previously. This change will not retroactively change an approved retirement or retired pay, but all future retirement pay calculations must abide by this law.
3. Officers considering voluntary retirement should carefully evaluate the impact of 10 USC §1370 upon their circumstances before making a voluntary retirement decision. Officers are encouraged to verify their time in grade through Direct Access - Self Service or contact their servicing Personnel and Administration (P&A) office for assistance in determining time in grade.
4. Officers electing to voluntarily retire, who do not meet the time in grade requirements of 10 USC §1370 to retain their highest grade held, will complete the Reserve Retirement Request, CG-2055A, and route it through their command and servicing dxr, to CG PSC-RPM. Link to the newly updated CG-2055A can be found at this location: https://www.dcms.uscg.mil/ppc/pd/forms/. Only the latest revision of CG-2055A (04/20) will be accepted.
5. CG PSC-RPM will evaluate the member's time in grade and determine whether the member meets the requirements of 10 USC §1370 to retain their current grade. This determination will be made on the CG-2055A with a copy provided to the member and command.
6. If an officer is required to retire at the lower grade satisfactorily held, PPC by direction from RPM, will make the adjustment in Direct Access and will calculate the member's retirement according to the lower grade held.
7. The requirements of 10 USC §1370 only apply to voluntary requirements.
8. Members who have to mandatorily retire as required by selection or retention board action or by a disability board, will retire at their current grade held and must retire on the date as required by the board dictating mandatory retirement.
