SUBJECT: Notice of Proposed Changes to the California Cartage Company, LLC, (Cal Cartage) Central Examination Station (CES) Fee Schedule and Solicitation for Comments.
PURPOSE: The purpose of this TIN message is to notify the trade community of the proposed revisions to the Cal Cartage Fee Schedule. The new proposed changes are summarized below, and the proposed Fee Schedule is attached for the public’s review and comments.
As set forth in Title 19 Code of Federal Regulations (CFR) Section (§) 118.2, the public is invited to submit any relevant written comments regarding the proposed changes; comments must be received within 30 calendar days from this notice.
After a review of the proposed fee schedule changes, any public comments theron, and based on the principles of comparability as set forth in 19 CFR § 119.11(c), the Port Director will decide whether to approve the changes on or after 90 calendar days from receipt of the written request.
BACKGROUND: U.S. Customs and Border Protection (CBP) regulation 19 CFR § 118.5 provides the procedures for changes to the CES service fee schedule. As provided for in 19 CFR § 118.5, the CES Operator (CESO) shall remain bound by the existing fee schedule and not implement any changes to it prior to obtaining written approval from the Port Director.
SUMMARY OF PROPOSED FEE SCHEDULE CHANGES:
Changes to the Fee Schedule are being proposed by the CESO as itemized below:

Increase Devanning Cargo for Examination Fee by 4% (Fee Schedule (FS) # 1): This fee applies to the devanning of containerized cargo in cartons, pallets or unitized cargo. This adjustment covers increases in inflation, labor and equipment costs. Changes proposed range from $9 to $30. See chart below.

Increase Facility Charge Fee for Full Container Loads (FCL) by 4% (FS # 3): This fee applies to all full container exams conducted at the facility. This change covers increases in facility lease, utilities, equipment, and ongoing operational costs. This fee would increase by $20 from $500 to $520.

Increase Seizure/Forfeiture Fee by 4% (FS # 4): This fee applies to services associated with the handling, storage and manipulation of seized shipments that are forfeited and destroyed. This fee covers increases in forfeited and destruction costs arising from trade and enforcement examinations and not agriculture exams. This fee would increase by $5 from $125 to $130.

Increase Tailgate Examinations Fee by 4% (FS # 5): This fee applies to both refrigerated and non-refrigerated cargo containers. This increase is associated with rising labor and warehouse handling costs. For non-refrigerated cargo containers with no unloading the cost will increase from $50 to $52. For refrigerated cargo containers requiring mandatory 2% CBP Agricultural Tailgate Inspection by CBP, there will be an increase from $100 to $104.

Increase Devanning Loose Cargo Load (LCL) Shipments Fee by 4% (FS # 6): This fee applies to the devanning of loose cargo loads. This adjustment applies to rising labor and warehouse handling costs. See charts below.

6. Increase Free Time and Storage of LCL by 4% (FS # 8): This fee applies to the storage timeframe after the trucker and/or broker has been notified that a CBP examination has been released. This adjustment applies to rising real estate and warehouse operating costs. This fee would increase by $0.09 cents from $2.25 to $2.34 per pallet, per day.
7. Increase On-Hold Handling (by 10%) and Storage (by 4%) for FCL/LCL (FS # 9): This storage fee applies to the charges that begin to accrue when a shipment has been placed on hold by CBP, or two business days after the freight has been devanned, whichever is sooner. This adjustment applies to increased labor intensity and administrative oversight. This fee would increase from $2.25 per pallet per day; $50 minimum to $2.34 per pallet per day; $55 minimum.
8. Increase Refrigerated Container-Yard by 4% (FS # 10): This fee applies to charges that will be incurred for all refrigerated containers in hourly increments. This adjustment covers higher electricity and equipment maintenance costs associated with refrigerated units. This fee would increase from $4.25 per hour to $4.42 per hour with a (10) minute grace period for pickup. Charges accrue hourly until out gated or empty.
9. Increase Certain Miscellaneous Exam Fees and Services by 4% to 10% (FS # 12):
- Increase multiple agency examinations when performed at the same time as initial examination by 4% from $100 per agency to $104 per agency.
- Increase set-up charge for examinations received and then cancelled (including 3 free days of storage) by 4% from $500 to $520.
- Increase hazardous material surcharge per examination by 4% from $150 to $156.
- Increase sorting and segregation, special projects (including stacking one high, second devan, other requests) by 4% from $50 per hour to $52 per hour.
- Increase palletizing (including materials and labor) by 10% from $20 per pallet to $22 per pallet.
- Increase air bag services if requested by $10% from $20 per air bag to $22 per air bag.
- Increase container flip charge by 4% from $200 to $208.
- Increase steamship line availability and/or release (if required) by 4% from $50 to $52.
10. Removal of the Daily Chassis Rental - 3 axle of flatbed (FS Page 10): This fee is currently $75 and will be removed. New rate will follow the existing Chassis Rental Fee clause to match the market rate plus $4 per day administrative fee. The CES states that this change allows the CES to follow the market conditions both up and down to be fair with market rates.
