CAMS # 67533440 - Withhold Release Order (WRO) on Coffee Harvested in Mexico by Finca Monte Grande
Effective January 29, 2026, and until further notice, U.S. Customs and Border Protection (CBP) is issuing a Withhold Release Order (WRO) on coffee harvested in Mexico by Finca Monte Grande. Pursuant to her delegated authority from the Commissioner of CBP under Delegation Order 19-001, the Acting Executive Assistant Commissioner, Office of Trade, directs CBP port personnel to withhold the release of these goods in accordance with 19 CFR § 12.42(e).
This WRO is the result of an investigation by CBP's Office of Trade (OT) whereby CBP obtained and evaluated information regarding Finca Monte Grande harvesting practices for possible violations of 19 U.S.C. § 1307. Following a thorough review, CBP determined that the information reasonably demonstrates that Finca Monte Grande, a Mexican company, harvested coffee using forced labor within the purview of 19 U.S.C. § 1307.
Forced labor, as defined in 19 U.S.C. § 1307, encompasses "all work or service which is exacted from any person under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily." OT's investigation and review analyzed supporting evidence that demonstrated workers at Finca Monte Grande are subject to six International Labour Organization (ILO) indicators of forced labor: retention of identity documents, abusive living and working conditions, debt bondage, withholding of wages, excessive overtime, and abuse of vulnerability.
The Acting Executive Assistant Commissioner, Office of Trade, directs OT personnel to monitor imports to ensure that importers do not evade this order. Additionally, for identified shipments within the redelivery period, please demand redelivery by issuing CBP Form 4647 pursuant to 19 CFR § 113.62. Importers whose products are detained under 19 CFR § 12.42(e) have the option to contest the withholding of the products' release pursuant to 19 CFR § 12.43 or to export the merchandise pursuant to 19 CFR § 12.44.
