TRADE INFORMATION NOTICE
This notice provides updated guidelines for the movement of condition of entry (COE) cargo requiring fumigation treatment as identified in 7 CFR 305.2(a), from the Port of New York/Newark to the facilities located at 1) Agra Fumigation, 221-20 147 Avenue, Jamaica, NY 11413 or 2) ASAK Solutions, P78 North Boundary Road, Jamaica, NY 11430. This procedure is valid for COE commodity cargo only. COE cargo which cannot be presented in manner that is conducive to conducting fumigation treatment may be reexported or destroyed at the importer’s expense as outlined in their USDA import permit.
Background: The Vanguard Pest Control treatment provider informed the United States Department of Agriculture, Animal and Plant Health Inspection Service (APHIS), Plant Protection and Quarantine (PPQ) that it will cease phytosanitary fumigations and close its treatment facility at the Newark, NJ location at the end of July 2025. Due to limited-service options for COE cargo arriving in the Port of New York/Newark, the following procedures will be authorized, effective August 1, 2025, or upon cessation of services by Vanguard Pest Control. Please note that Vanguard will not accept shipments after July 24, 2025. All shipments must be picked up on or before July 30, 2025.
APHIS Guidance:
- Prior to authorizing a bonded movement, Customs and Border Protection (CBP) agriculture specialists will conduct a physical inspection of containers to ensure they are free of contaminants, such as soil, debris, or animal waste, and that there are no hitchhiker pests, such as snails.
- Only COE commodities are eligible for movement.
- For non-COE cargo with an Emergency Action Notification (EAN), Quarantine Policy, Analysis and Support (QPAS) and CBP will review and identify pest mitigation options on a case-by-case basis.
- Customs and Border Protection Agriculture Specialists (CBPAS) will use approved CBP procedures to facilitate the bonded movement of COE cargo to an APHIS approved facility. All actions shall be reported in approved CBP systems.
