On August 12, 2024: “A Proclamation to Further Facilitate Positive Adjustment to Competition From Imports of Certain Crystalline Silicon Photovoltaic Cells (Whether or Not Partially or Fully Assembled Into Other Products)” published on WhiteHouse.gov. The proclamation authorizes expansion of the tariff rate quota (TRQ) limit to 12.5 Gigawatts (GW) annually. Crystalline Silicon Photovoltaic (CSPV) products subject to the TRQ limit entered on or after August 1, 2024, are included in the modified TRQ limit of 12.5 GW.
For CBP Quota accounting purposes on the Commodity Status Report, the 7.5 GW increase will appear as a separate line item for the expanded limit through February 6, 2025.
This is in alignment with Presidential Proclamation 10339 of February 4, 2022, under Section 201 of the Trade Act of 1974 providing for a TRQ for CSPV cells and an additional duty for modules comprised of CSPV cells.
Solar (CSPV) Cells are limited on an annual basis: February 7, 2024, to February 6, 2025 – 12,500,000,000 watts (12.5 GW)
Filers can continue to enter solar cells for quota using the same HTS sequence noted in the quota bulletin. The expanded limit does not modify quota procedures.
Please refer to Quota Bulletin QB 24-507 2024 Solar Cells and Modules Amended August 13, 2024, which addresses tariff rates and quantity thresholds for February 7, 2024, to February 6, 2025.
