CSMS # 60433556 - Department of Commerce Modifications to Antidumping Duty and Countervailing Duty Regulations
n March 25, 2024, the Department of Commerce (Commerce) published a final rule modifying existing antidumping duty (AD) and countervailing duty (CVD) regulations to improve, strengthen, and enhance its enforcement of the AD and CVD laws (Regulations to Improve Administration and Enforcement of Antidumping and Countervailing Duty Laws). These regulations apply to various aspects of AD/CVD proceedings, including filing requirements; scope, circumvention, and covered merchandise inquiries; reference to and reliance on new factual information; the CVD facts available hierarchy; surrogate value and CVD benchmark selections; particular market situations; and certain types of countervailable subsidies. The regulations became effective April 24, 2024.
