CSMS # 59518814 - UPDATED GUIDANCE FOR THE EXECUTIVE ORDER 14114 OF DECEMBER 22, 2023, Authorizing Certain Transactions Related to Imports of Certain Categories of Fish, Seafood, and Preparations Thereof Prohibited by Executive Order 14068, General License 83A.
On February 20, 2024, the Office of Foreign Assets Control (OFAC) issued General License (GL) 83A: “Authorizing Certain Transactions Related to Imports of Certain Categories of Fish, Seafood, and Preparations Thereof Prohibited by Executive Order 14068.” GL 83A supersedes OFAC GL 83. To qualify for GL 83A all the following conditions need to be satisfied.
1) Importation of prohibited seafood and seafood derivative products covered by Executive Order 14114 into the United States were loaded onto a vessel at the port of loading prior to 12:01 a.m. eastern standard time February 20, 2024
2) Importation of prohibited seafood and seafood derivative products covered by Executive Order 14114 into the United States has a written contract or written agreement prior to December 22, 2023
GL 83A is authorized through 12:01 a.m. eastern daylight time, May 31, 2024.
CBP is not authorized to modify or extend GL 83A beyond 12:01 a.m. eastern daylight time, May 31, 2024. Extensions or modifications to GL 83A must be requested with OFAC through OFAC’s General License application portal. Filing Requirements for GL 83A
Beginning February 20, 2024, all entry and certified from summary transactions as well as goods admitted into a Foreign Trade Zone that include the affected commodities will require an upload of purchase orders and/or executed contracts and/or any other documentation showing when the order and/or contract went into effect to be uploaded to the Automated Commercial Environment (ACE) Document Image System (DIS).
The trade community must follow these requirements to submit the GL 83A supporting documentation to DIS:
• CBP as the Agency Code;
• Other as the Official Document Name/Description;
• Other as the Document Type;
• Other as the Document Label Code;
• CBP03 as the DocCode.
