On Wednesday, May 3, 2023 the Department of Commerce, U.S. Census Bureau published a Notice of Proposed Rulemaking (NPRM) that announced the proposal for the collection of a new data element - Category XXI Determination Number in the Automated Export System.

The Directorate of Defense Trade Controls has published Frequently Asked Questions regarding this modification to the AES and they can be found at https://www.pmddtc.state.gov/. Please follow here to review the DDTC FAQs:

Navigate to the heading "Support" and then click on "Review FAQs".
Under "Topic Areas", click on "ITAR/USML Updates"
Then select "Automated Export System"

For questions regarding this upcoming AES change, please contact the Department of Defense Trade Control at: ddtccustomerservice@state.gov or (202) 663-1282.

Please note that this change will impact both the AESDirect application as well as filers submitting via Electronic Data Interface (EDI).

Exporters and Software Developers that submit Electronic Export Information (EEI) via the Electronic Data Interface (EDI) should update their software to send the proposed new data element.

For technical questions, Software Vendors should contact their respective CBP Client Representative.
