CSMS # 54387706 - Delay in ACE Employee Upload Feature in Modernized Portal
Please see the guidance below about updates to the Modernization of the Customs Broker Regulations.
1. New and Terminated Employee Reporting - Pursuant to the Modernization of the Customs Broker Regulations Final Rule (87 FR 63267) under 19 CFR 111.28(b)(2) and (3), brokers must submit new employee and terminated employee information within 30 days of employment and termination, respectively.
a. Brokers with an ACE Portal Account - During the week of December 19, 2022, the ACE employee upload feature will be unavailable to the trade and CBP users while CBP transfers employee information from the local permits to the national permit. The ACE Information Notice for trade users will be updated to reflect this guidance. While this feature is unavailable in the ACE portal, brokers with an ACE portal account may satisfy the 30-day reporting requirement to report new and terminated employees by providing the information in writing to their processing Center. CBP will issue another message when this feature is available.
b. Brokers without an ACE Portal Account - Brokers without an ACE portal account must satisfy the 30-day reporting requirement to report new and terminated employees by providing the information in writing to the processing Center.
Current Employee List - Pursuant to the Modernization of the Customs Broker Regulations Final Rule (87 FR 63267) under 19 CFR 111.28(b)(1), brokers must submit a list of names of persons currently employed and, after initial submission, update the list if any of the required information changes.
a. Brokers with an ACE Portal Account - Brokers who have an ACE Portal Account must maintain current employee information in the ACE Portal. CBP will allow those brokers to satisfy this requirement to submit and maintain a current list of employees in the ACE portal no later than February 17, 2023. Brokers are reminded to validate employee information transferred from the local permits to the national permit in ACE to ensure all information is up-to-date and accurate no later than February 17, 2023.
b. Brokers without an ACE Portal Account - Brokers who do not have an ACE Portal Account and have previously reported their employees in writing to the local permitting port location must submit a current list of employees to the processing Center no later than February 17, 2023.
