CSMS # 54387351 - REMINDER: December 19, 2022 is the Final Rule Effective Date for the Modernized Customs Broker Regulations 19 CFR 111
Monday, December 19, 2022 is the effective date of the Modernization of the Customs Broker Regulations (87 FR 63267) and Elimination of Customs Broker District Permit Fee (87 FR 63262) Final Rules. CBP will also deploy Broker Reporting and National Broker Permit enhancements in the Automated Commercial Environment (ACE) on December 19 to reflect changes in the Final Rules. Please see this CSMS Message for more details on these ACE deployments.
CBP has updated the Frequently Asked Questions section on the Customs Broker Modernization Webpage to include information on topics of interest including: employee reporting, knowledgeable point of contact, and Power of Attorney requirements.
On the effective date, key changes in the Final Rules that will be in effect include:
- Transitioning to a national permit framework
- Transitioning broker reporting capabilities from Legacy ACE Portal to the Modernized ACE Portal
- Establishing that customs business is conducted within the U.S. customs territory and requiring brokers to designate a knowledgeable point of contact
- Revising the broker/client relationship requirements
- Updating responsible supervision and control oversight requirements
