CSMS #50274160 - U.S. EPA Import Requirements for Hydrofluorocarbons (HFCs) under the AIM Act
The purpose of this message is to announce an upcoming webinar on December 9, 2021, to be held in conjunction with the Environmental Protection Agency (EPA). This webinar will provide information about importing hydrofluorocarbons (HFCs), including upcoming filing requirements in ACE.
The American Innovation and Manufacturing (AIM) Act directs EPA to phase down production and consumption of HFCs in the United States by 85 percent by 2036. HFCs are potent greenhouse gases, many of which have global warming potentials hundreds to thousands of times that of carbon dioxide. HFCs are commonly used in many sectors of the economy, including in refrigeration and air conditioning, aerosols, solvents, fire suppression, and as foam blowing agents.
Consistent with the phasedown, starting January 1, 2022, there are new requirements for imports of HFCs. More specifically, imports of bulk HFCs and HFC blends of any quantity require allowances, subject to limited exceptions. In addition, EPA is requiring information to be electronically filed through ACE 14 days prior to importation. More information about the AIM Act and EPA’s regulations can be found at: https://www.epa.gov/climate-hfcs-reduction. In addition, a fact sheet for importers can be found here: https://www.epa.gov/system/files/documents/2021-11/hfc-allocation-rule-importer-requirements-fact-sheet.pdf.
