CSMS #45782283 - Retail Sales Programing Issue: Interim Solution for Drawback Exports to Canada and Mexico
Please be advised that USMCA for Drawback deployed to the Certification (CERT) environment on January 14, 2021, as previously announced in CSMS message # 45195422, dated December 17, 2020.
Due to unforeseen programming difficulties and the need to perform a programming update, the ability to file a claim under 19 USC 1313(c)(1)(c)(ii) (ACE provision codes 56 and 70) that include exports to Canada (CA) or Mexico (MX) will be temporarily unavailable. Such claims that are filed during this temporary system suspension for programming updates will receive an ACE rejection with fatal error code “F039” (for MX exports) and/or “F041” (for CA exports). NOTE: This ACE rejection error code does not constitute a decision by CBP on the validity of the drawback claim.
This validation also deployed to CERT on January 14, 2021 and will deploy to PROD on March 13, 2021.
CBP recommends that claimants delay filing claims under 19 USC 1313(c)(1)(C)(ii) (ACE provision codes 56 and 70) that include exports to Canada (CA) or Mexico (MX) until the ACE programming update is complete. If a filing delay would cause a drawback claim to become untimely, claimants should timely file the claim in ACE and retain a copy of the ACE rejection message as proof of the filing date; CBP will then accept and backdate valid claims after the programming update is complete. Please note that another CSMS will be sent to the trade to confirm when claims can be filed again in ACE for provision codes 56 and 70.
