Publication of the Foreign Trade Regulations (FTR):  Clarification on the Collection and Confidentiality of Kimberley Process Certificates (KPC):

The Census Bureau’s International Trade Management Division (ITMD) is announcing the publication of a Final Rule revising the Foreign Trade Regulations (FTR), Title 15, Part 30.  This Final Rule amends the FTR to clarify that the data collected from the KPC are collected in accordance with the Clean Diamond Trade Act, 19 U.S.C. Section 3901 et seq.  The Clean Diamond Trade Act (CDTA) requires importers and exporters of rough diamonds to comply with the Kimberley Process Certification Scheme (KPCS) by submitting the KPC as mandated. The requirements of the CDTA are promulgated through the Office of Foreign Assets Control’s (OFAC) Rough Diamonds Control Regulations, Title 31, Code of Federal Regulations (CFR), Part 592 and the KPCS Core Document.  Additionally, the United States is required to produce statistics on imports and exports of rough diamonds and to make these statistics available for analysis by interested parties, including Kimberley Process participants.  To meet this requirement, the Census Bureau began collecting KPCs for all import and export shipments in January 2006.  However, the data collected from the KPCs are separate and distinct from the statistical data collected under Title 13 and are not governed by the confidentiality provisions of that act.
