Fiscal Year (FY) 2024 Airport Improvement Program (AIP) Update

 

Dear Airport Sponsors:

 

Earlier this year, the President signed the Consolidated Appropriations Act of 2024 into law (P.L. 118-42) that provided $3.35 billion in funding for the FY 2024 AIP.  The President signed the FAA Reauthorization Act of 2024 into law (P.L. 118-63) on May 16.  This law provides full access to these funds and overall long-term FAA funding stability through FY 2028. Over the next several months, FAA will be working to develop guidance on the various eligibility provisions enacted in the Reauthorization, taking effect in mostly in FY 2025.

 

For FY 2024, we will need to implement the current year appropriation and the associated applicable administrative provisions in the authorization.  This GovDelivery message is our first step to expedite this process. 

 

Please take note of the one-time provision in the Joint Explanatory Statement accompanying the Appropriations Bill providing no less than $5,000,000 of AIP funds for Per- and Polyfluoroalkyl Substances (PFAS) removal or destruction, discussed further below.  

 

Also, take note of Section 747 of the Reauthorization Act, which states, “Notwithstanding part 200 of title 2, Code of Federal Regulations, or any other provision of law, funds made available as part of the Airport Improvement Program under subchapter I of chapter 471 or chapter 475 of title 49, United States Code, shall not be subject to any public notice of funding opportunity requirement.”

 

FY 2024 AIP Grant Administration: 

For FY 2024 AIP grant funding, new funding levels and many other programmatic adjustments contained in the Reauthorization begin in FY 2025. However, as stated, FAA must move quickly to execute the funding now available for AIP in FY 2024.  We offer the following guidelines as you work with your local field offices in moving forward with grant requests in FY 2024:

 

• Notice of Use of Entitlement Funding, Federal Register Notice 89 FR 23081 (issued April 4, 2024), established key grant administration dates in FY 2024, including:
  • May 20, 2024: Deadline for airport sponsors to notify and submit their final grant application for entitlements, based on bids.
  • June 3, 2024: The FAA will carry over the available entitlement funds. These funds will not be available again to the airport sponsor until the beginning of FY 2025. Work with your field office to designate carry-over prior or by this deadline.
• Requests for discretionary funding have been coordinated earlier in the year, and the FY 2024 Discretionary Candidate List (DCL) is set. Per Section 747 of the FAA Reauthorization Act of 2024, this Gov Delivery message takes the place of a FY 2024 Notice of Funding Opportunity (NOFO) for traditional AIP discretionary funds.  FAA will review FY 2024 grant applications for discretionary funds as in prior years based on our long-standing Airports Capital Improvement Program (ACIP) process.  The application deadline to submit all requests to the FAA for AIP discretionary funding is Monday, July 15, 2024.
• As always, work with your local field office (ADO/RO) on both entitlement and discretionary funding requests to ensure FAA can obligate all available funds prior to the end of the FY.

 

FY 2024 PFAS Grants: 

The Joint Explanatory Statement accompanying the FY 2024 Consolidated Appropriations Act of 2024 requires no less than $5 million of AIP be dedicated to addressing PFAS at airport facilities. The aim of this provision is to fund:

 

• demonstration projects for airports to collect and remove uncontained contaminants caused by Aqueous Film Forming Foam (AFFF) and other PFAS waste resulting from aviation operation; and to
• field test and measure lab-proven, innovative destruction technologies to measurably reduce and mitigate the aviation impacts of PFAS and AFFF substances on surface and groundwater quality at the airport or within five miles of the airport.

 

Given our condensed timeline to enact the FY 2024 AIP, the FAA is requesting airports work with their local field offices to identify projects that remove PFAS contamination or projects for field testing and measuring innovative PFAS contamination destruction technologies.  Please reach out to your local field office by Monday, June 17, 2024, to provide project information so that it may be included as part of our long-standing ACIP process.  Projects identified will need to be able to meet all statutory and administrative requirements to be under grant by Friday, August 30, 2024.
