Mae'n rhaid i bob darparwr cofrestredig gymryd camau erbyn Dydd Mawrth, 17 Tachwedd 2020
1) Hysbysu am ddigwyddiadau i Arolygiaeth Gofal Iechyd Cymru (AGIC)
Hoffem atgoffa pob darparwr cofrestredig am y ddyletswydd gyfreithiol i'n hysbysu am ddigwyddiadau penodol (‘digwyddiadau rhagnodedig’) yn gyson ac amserol.
Mae Rheoliadau 30 a 31 o Reoliadau Gofal Iechyd Annibynnol (Cymru) 2011 yn nodi bod yn rhaid i berson cofrestredig unrhyw ysbyty annibynnol, clinig annibynnol neu asiantaeth feddygol annibynnol roi gwybod i ni am ddigwyddiadau penodol sy'n gysylltiedig â diogelwch y cleifion.
Digwyddiadau Hysbysadwy
Mae nifer o ddigwyddiadau rhagnodedig y mae'n rhaid rhoi gwybod i ni amdanynt o dan y rheoliadau. Mae'r rhain yn cynnwys:
- Marwolaeth claf
- Absenoldeb heb awdurdod claf sy'n cael ei gadw
- Unrhyw anaf difrifol i glaf
- Achos o glefyd heintus
- Honiad o Gamymddwyn yn erbyn Aelod o'r Staff sy'n arwain at niwed go iawn neu niwed posibl i glaf
- Atgyfeiriad Trefniadau Diogelu wrth Amddifadu o Ryddid (DoLS)
- Digwyddiad sy'n ymwneud â Rheoliadau Ymbelydredd Ïoneiddio (Cysylltiad Meddygol) (IR(ME)R) (mae angen cyflwyno hysbysiad ar wahân)
- Digwyddiadau eraill (e.e. penodi rheolwr newydd, absenoldeb rheolwr cofrestredig, euogfarnu unrhyw berson cofrestredig ac ati)
Dylech gyfeirio at y Canllawiau ar gyfer Darparwyr a Rheolwyr Cofrestredig i gael trosolwg o'r digwyddiadau hyn a'r amserlen ar gyfer rhoi gwybod amdanynt.
Beth yw goblygiadau hyn yn sgil COVID-19?
Mae'r rheoliadau yn ei gwneud yn ofynnol i ddarparwyr ein hysbysu am ddigwyddiadau sy'n gysylltiedig ag achosion o glefydau heintus, anafiadau difrifol a/neu os bydd claf/cleifion yn marw. Yn ystod y pandemig, mae angen rhoi gwybod am y digwyddiadau canlynol:
- Achosion o COVID-19 a gadarnhawyd ymhlith y cleifion a/neu'r staff;
- Unrhyw glaf sy'n dioddef anafiadau difrifol neu sy'n marw o ganlyniad i COVID-19.
Er nad yw'r rheoliadau'n diffinio 'achos' nac 'anaf difrifol', disgwylir i Reolwyr Cofrestredig fod yn bwyllog ac yn dryloyw wrth werthuso digwyddiadau. Disgwylir y caiff hysbysiadau eu cyflwyno fel mater o drefn, ac mae'n rhaid i Reolwyr Cofrestredig fynd ati i ymgysylltu â ni os bydd unrhyw amheuon ynghylch p'un a ddylid rhoi gwybod am ddigwyddiad ai peidio.
Mae'n ofynnol i chi ein hysbysu am y digwyddiadau uchod o fewn 24 awr i ddechrau'r digwyddiad (os bydd hyn ar lafar, mae'n rhaid cadarnhau hyn yn ysgrifenedig gan ddefnyddio'r ffurflen briodol o fewn 72 awr i hysbysu ar lafar).

2) Hysbysiadau ôl-weithredol
Rydym yn gofyn i bob darparwr cofrestredig adolygu pob digwyddiad ers 23 Mawrth 2020 a'n hysbysu'n ôl-weithredol am unrhyw ddigwyddiadau y dylid bod wedi rhoi gwybod i ni amdanynt ar adeg y digwyddiad.
Dylai pob darparwr cofrestredig wneud y canlynol:
- a) Sicrhau bod unrhyw hysbysiadau ôl-weithredol yn cael eu cyflwyno i ni gan ddefnyddio'r ffurflen briodol, un ai drwy'r porth diogel (Objective Connect) neu drwy lythyr 'Signed for', NEU
- b) Anfon neges 'dim ymateb' drwy e-bost at: agic@llyw.cymru gan ddatgan nad oes unrhyw ddigwyddiadau hysbysadwy / digwyddiadau na roddwyd gwybod amdanynt ers 23 Mawrth 2020.
Mae'n rhaid cyflwyno'r wybodaeth hon erbyn Dydd Mawrth, 17 Tachwedd 2020. Ewch i'n gwefan i gael rhagor o ganllawiau ar sut i'n hysbysu am ddigwyddiad.
Dylai darparwyr nodi na ddylid ystyried cyflwyno hysbysiadau ôl-weithredol yn arfer safonol, ac fel arfer mae'n rhaid i ddarparwyr gyflwyno hysbysiadau o fewn yr amserlenni penodol.
Gall peidio â rhoi gwybod i AGIC am ddigwyddiad hysbysadwy o fewn yr amserlenni a nodwyd yn y rheoliadau olygu y gallai AGIC gymryd camau gorfodi.

Action from all registered providers is required by Tuesday 17 November 2020
1) Notification of events to Healthcare Inspectorate Wales (HIW)
We would like to remind all registered providers of the legal duty to notify us of particular events (‘prescribed events’) in both a consistent and timely manner.
Regulations 30 and 31 of the Independent Health Care (Wales) Regulations 2011 state that the registered person of an independent hospital, independent clinic or independent medical agency must notify us about particular events that occur relating to patient safety.
Notifiable events
There are a number of prescribed events, of which we must be notified under the regulations. These include:
- Death of a patient
- Unauthorised absence of detained patient
- Any serious injury to a patient
- Outbreak of infectious disease
- Allegation of staff misconduct resulting in actual or potential harm to a patient
- Deprivation of Liberty Safeguard (DoLS) referral
- IR(ME)R incident (subject to separate notification)
- Other events (e.g. appointment of new manager, absence of registered manager, conviction of registered persons etc.)
Refer to the Guidance for Registered Providers and Managers for an overview of these events and the timescales in which these must be reported.
What does this mean for COVID-19?
The regulations require providers to notify us of events relating to infectious outbreaks, serious injuries and/or death of patient(s). During the pandemic, these notifications are applicable to:
- Confirmed positive COVID-19 outbreaks involving patients and / or staff;
- Serious injuries or death relating to a patient as a result of COVID-19.
Whilst the regulations do not define ‘outbreak’ or ‘serious injury’, Registered Managers are expected to excise sound judgment and transparency when evaluating incidents. Notifications are expected to be submitted as a matter of course and Registered Managers must proactively engage with us should there be any doubt as to whether an event is reportable or not.
You are required notify us of the above events within 24 hours of the beginning of the event (if given verbally, this must be confirmed in writing using the appropriate form within 72 hours of the verbal notification).

2) Retrospective notifications
We are requesting that all registered providers review all incidents that have taken place since 23 March 2020, and to notify us retrospectively of any outstanding events that should have been reported to us at the time of the event taking place.
Please could all registered providers:
- a) Ensure that any retrospective notifications are submitted to us using the appropriate form via either the secure portal (Objective Connect) or via signed for delivery, OR
- b) Provide a ‘nil return’ via email to: hiw@gov.wales stating that there have been no notifiable events / no unreported events since 23rd March 2020.
The deadline for submitting this information is Tuesday 17 November 2020. Please see our website for further guidance on how to notify us of an event.
Providers should note that the submission of retrospective notifications is not to be considered a standard procedure, and providers must ordinarily submit notifications within the specified timescales.
Failing to notify us of a notifiable event within the timescales stated in the regulations could result in HIW taking enforcement action.
