Heddiw, mae Llywodraeth y DU wedi cyhoeddi manylion ar wefan GOV.UK (Dolen Saesneg yn unig) ynghylch diwygiadau ar gyfer ardystio marwolaethau y bydd yn eu cyflwyno o fis Ebrill 2024 ymlaen. Caiff y diwygiadau eu hegluro yn y ddogfen Trosolwg o’r Diwygio Ardystio Marwolaethau a'r rheoliadau drafft ar gyfer gweithredu'r newidiadau yn. Dylid darllen y rhain ar y cyd â fersiwn ddrafft o Reoliadau Archwilwyr Meddygol (Cymru) a gyhoeddir heddiw hefyd yn:

Yn ogystal, mae Eluned Morgan, y Gweinidog Iechyd a Gwasanaethau Cymdeithasol wedi cyhoeddi Datganiad Ysgrifenedig.
Bydd y rheoliadau drafft a'r ddogfen Diwygio Ardystio Marwolaethau yn helpu ymarferwyr meddygol, cofrestryddion, crwneriaid a'r cyhoedd i ddeall sut y bydd y gofynion cyfreithiol newydd yn gweithio. Byddant hefyd yn helpu i sicrhau bod gwasanaethau rheng flaen yn barod ar eu cyfer.
Bydd y diwygiadau yn dod i rym ym mis Ebrill 2024 ac yn effeithio ar bob darparwr gofal iechyd ac ymarferydd meddygol a allai fod yr ymarferydd sy'n gweini pan fydd rhywun yn marw. Byddant yn rhoi holl rwymedigaethau, dyletswyddau a chyfrifoldebau y system archwilio meddygol ar sail statudol ac yn sicrhau eu bod yn cael eu cydnabod gan y gyfraith.
Ar ôl i'r diwygiadau ardystio marwolaethau ddod i rym, bydd pob marwolaeth yng Nghymru a Lloegr yn cael ei hadolygu'n annibynnol, yn ddieithriad, naill ai gan archwilydd meddygol neu grwner.
Er mwyn sicrhau bod y diwygiadau yn cael eu deall yn gyffredinol a bod ymarferwyr meddygol ac eraill yn deall yr hyn y byddant yn ei olygu iddyn nhw, mae'r Archwilydd Meddygol Cenedlaethol wedi creu podlediad (Dolen Saesneg yn unig) sy'n egluro'r broses newydd. Bydd Coleg Brenhinol y Patholegwyr hefyd yn cynnal digwyddiad i rannu gwybodaeth ar 17 Ionawr 2024. Bydd canllawiau perthnasol a ddarperir ar wefan GOV.UK, gan Swyddfa'r Archwilydd Meddygol Cenedlaethol a chan Swyddfa'r Prif Grwner yn cael eu diweddaru yn unol â'r newidiadau statudol o fis Ebrill 2024 ymlaen.
Os nad ydynt eisoes wedi gwneud, dylai pob darparwr gofal iechyd, gan gynnwys meddygfeydd sefydlu prosesau i ddechrau atgyfeirio marwolaethau i swyddfeydd archwilwyr meddygol. Bydd hyn yn rhoi cyfle i weithdrefnau wreiddio ac yn osgoi tarfu a gofid i bobl mewn profedigaeth pan ddaw'r rheoliadau i rym. Mae podlediad ar gael sy'n trafod sut y gall archwilwyr meddygol gynorthwyo ymarferwyr cyffredinol (Dolen Saesneg yn unig) a'u gwaith gyda phobl mewn profedigaeth.
Tystysgrif Feddygol Ddigidol o Achos Marwolaeth
Mae Awdurdod Gwasanaethau Busnes y GIG ac Adran Iechyd a Gofal Cymdeithasol Llywodraeth y DU yn llunio Tystysgrif Feddygol ddigidol o Achos Marwolaeth ar gyfer Cymru a Lloegr.
Os yw cwblhau neu drin Tystysgrifau Meddygol o Achos Marwolaeth yn rhan o'ch swydd mewn unrhyw ffordd, gallwch gymryd rhan yn yr ymchwil a chyfrannu at lunio dyluniad y Dystysgrif Feddygol o Achos Marwolaeth ar gyfer y dyfodol. Mae angen cynifer o bobl â phosibl i gymryd rhan er mwyn datblygu gwasanaeth digidol effeithiol a chynhwysol.

Arolwg addasu

Mae hyn o ganlyniad i reoliadau newydd o dan Ddeddf Rheoleiddio ac Arolygu Gofal Cymdeithasol (Cymru) 2016.
Yn gynharach eleni, cynhaliodd Llywodraeth Cymru ymgynghoriad ar reoliadau drafft i ddiffinio a rheoleiddio gwasanaethau preswyl ysgolion arbennig, y cyfeiriwyd atynt yn flaenorol fel ysgolion arbennig preswyl.
Bydd Rheoliadau Gwasanaethau Rheoleiddiedig (Gwasanaethau Preswyl Ysgolion Arbennig) (Cymru) 2023 a Rheoliadau Gwasanaethau Rheoleiddiedig (Cofrestru) (Cymru) (Diwygio) 2023 yn dod i rym ar 31 Rhagfyr 2023.
Bydd y rheoliadau newydd yn diffinio "gwasanaeth preswyl ysgol arbennig" fel gwasanaeth rheoleiddiedig newydd o dan adran 2 o Ddeddf 2016, ac yn ei gwneud yn ofynnol i'r gwasanaethau hyn gofrestru â ni.
Yn y gorffennol, dim ond arolygu'r math hwn o wasanaeth a wnaethom, yn hytrach na'i gofrestru hefyd.

Ni fydd angen i'r gwasanaethau hyn gofrestru â ni ar unwaith. Bydd canllawiau cofrestru ar gael ar ein gwefan o 1 Chwefror 2024, yn ogystal â chanllawiau pellach am ysgrifennu datganiad o ddiben.
Bydd y porth ar-lein yn mynd yn fyw ar 1 Mawrth 2024 a bydd yn cau ar 30 Mehefin 2024.

Statutory scrutiny of deaths by medical examiners |

The UK Government has today published on GOV.UK details of reforms to death certification which it will introduce from April 2024. The reforms are explained in the Overview of Death Certification Reform document and the draft regulations to implement the changes. These should be read alongside the draft Medical Examiners (Wales) regulations also published today at:

Eluned Morgan, Minister for Health and Social Services has also issued a Written Ministerial Statement.
The draft regulations and Death Certification Reform document will help medical practitioners, registrars, coroners and the public understand how the new legal requirements will work and will help ensure frontline services are ready.
The reforms will come into force from April 2024 and affect all healthcare providers, and medical practitioners who may be the attending practitioner when a person dies. They will put all of the medical examiner system’s obligations, duties and responsibilities on to a statutory footing and ensure they are recognised by law.
Once the death certification reforms come into force, all deaths in England and Wales will be independently reviewed, without exception, either by a medical examiner or a coroner.
To support overall understanding of the reforms and what they will mean for medical practitioners and others, the National Medical Examiner has released a podcast explaining the new process. The Royal College of Pathologists will also be holding an information event on 17 January 2024. Relevant guidance provided on GOV.UK and from the National Medical Examiner’s Office and Office of the Chief Coroner will be updated in line with the statutory changes from April 2024.
All healthcare providers including GP practices should set up processes to start referring deaths to medical examiner offices if they have not already done so. This will allow procedures to bed in and avoid disruption and distress for bereaved people when the regulations come into force. A podcast is available exploring how medical examiners can support GPs and their work with bereaved people.
Digital Medical Certificate of Cause of Death
The NHS Business Services Authority and the Department of Health and Social Care are developing a digitised Medical Certificate of Cause of Death (MCCD) for England and Wales.
If your role involves completing or handling MCCDs in any capacity, you can take part in the research and be involved in shaping the design of the future digital MCCD. As many people as possible are needed to take part to build an effective and inclusive digital service.
The research sessions will be at times convenient to users and NHSBSA will make sure they fit around colleagues’ availability. If you would like to participate, please complete the survey and provide your contact details.

Adaptation survey
Please complete this short survey, to contribute to a baseline assessment of adaptation action across the Welsh Health and Social Care sector, being run by Local Partnerships on behalf of the Welsh Government’s Adaptation Project Board. There are no right or wrong answers, the survey seeks to capture where there are opportunities and the requirement for capacity building, as well as where there are barriers to action, or where these are entirely new concepts, so please provide your thoughts here: Complete the survey now
All contributions will be used to develop the training and guidance material for the sector and to respond to the Climate Change Committee’s Adaptation Progress Report recommendations, and place the health and social care sector in a positive position for future ways of working.
We will start registering special school residential services from 2024

This is due to new regulations under the Regulation and Inspection of Social Care (Wales) Act 2016.
Earlier this year, Welsh Government consulted on draft regulations to define and regulate special school residential services, formerly known as residential special schools.
The Regulated Services (Special School Residential Services) (Wales) Regulations 2023 and the Regulated Services (Registration) (Wales) (Amendment) Regulations 2023 will come into force on 31 December 2023.
The new regulations will define "special school residential service" as a new regulated service under section 2 of the 2016 Act, and require them to register with us.
Historically we have only inspected this type of service, rather than register them as well.

Registering with us
These services will not be required to register with us immediately. Registration guidance will be available on our website from 1 February 2024, as well as further guidance about writing a statement of purpose.
The online portal will go live on 1 March 2024 and will close on 30 June 2024.
