Annwyl ddarparwr,

Rydym yn ysgrifennu i roi gwybod i chi fod Llywodraeth Cymru wedi cyhoeddi crynodeb o'r ymatebion i'w hymgynghoriad diweddar ar ddileu’r diwygiadau cysylltiedig â coronafeirws i'r gofynion ar ddarparwyr cartrefi gofal i oedolion a gwasanaethau cymorth cartref.

Beth sy’n newid?

Mae’r Rheoliadau'n golygu y bydd y canlynol yn berthnasol o ddydd Mawrth 1 Tachwedd 2022 ymlaen:

  • Ni fydd eithriad rhag cofrestru fel gwasanaeth cartref gofal i'r rhai sy'n darparu llety ynghyd â nyrsio neu ofal, i oedolion, lle bo angen o ganlyniad i ledaeniad y coronafeirws.
  • Ni fydd eithriad rhag cofrestru fel gwasanaeth cymorth cartref i'r rhai sy'n darparu gofal a chymorth, i oedolion, lle bo angen o ganlyniad i ledaeniad y coronafeirws.
  • Rhaid i ddarparwyr gwasanaethau cartrefi gofal sy’n gyfan gwbl neu'n bennaf ar gyfer oedolion, neu wasanaethau cymorth cartref i oedolion, gael a darparu yn y gwasanaeth yr holl wybodaeth a dogfennau y mae eu hangen yn Atodlen 1 i Reoliadau 2017. 
  • Ni fydd darparwyr gwasanaethau’n gallu gwneud cais i AGC i fynd yn uwch na 15% o gyfanswm nifer yr oedolion sy'n cael eu lletya gan y gwasanaeth mewn ystafelloedd a rennir.
  • Rhaid i ddarparwyr gwasanaethau sy'n gwneud cais i gofrestru neu i amrywio eu cofrestriad presennol, i ddefnyddio mangreoedd sydd heb eu meddiannu ar hyn o bryd – a oedd wedi’u cofrestru’n flaenorol o dan unrhyw ddeddfwriaeth berthnasol – i ddarparu cartref gofal, llety diogel neu wasanaethau preswyl i deuluoedd, sicrhau bod y rhain yn bodloni'r gofynion mangreoedd ychwanegol a nodwyd yn Rhan 13 o Reoliadau 2017.

Dear provider,

We are writing to let you know that Welsh Government has published a summary of responses to its recent consultation about removing the coronavirus-related amendments to requirements on providers of adult care home and domiciliary support services.

You can read the report here. Regulations to achieve this will come into force on 1 November 2022.

 

What is changing?

The Regulations mean that from Tuesday 1 November 2022:

  • There will be no exception from registration as a care home service for those providing accommodation together with nursing or care, for adults, where needed as a result of the spread of coronavirus.
  • There will be no exception from registration as a domiciliary support service for those providing care and support, for adults, where needed as a result of the spread of coronavirus.
  • Providers of care home services, wholly or mainly for adults, or domiciliary support services for adults, must obtain and make available at the service all information and documentation required in relation to staff (in Schedule 1 of the 2017 Regulations).
  • Service providers will not be able to apply to vary their registration to exceed 15% of the total number of adults accommodated by the service in shared rooms.
  • Service providers applying to register or to vary their existing registration, to use currently unoccupied premises – that were previously registered under any relevant legislation – for the provision of a care home, secure accommodation or residential family centre service, must ensure these meet the additional premises requirements set out in Part 13 of the 2017 Regulations.
