Cofrestru gweithwyr gofal cymdeithasol gyda Gofal Cymdeithasol Cymru

Annwyl ddarparwr,

Ar hyn o bryd, rhaid i’r holl staff gofal sy’n gweithio mewn cartrefi gofal i blant, llety diogel neu wasanaethau cymorth cartref gofrestru gyda Gofal Cymdeithasol Cymru o fewn chwe mis i’r dyddiad y maent yn dechrau eu cyflogaeth.

Bydd y gofyniad hwn yn cael ei ymestyn i holl weithwyr cartrefi gofal i oedolion yng Nghymru o 1 Hydref 2022.

Bydd gan weithwyr newydd chwe mis i gofrestru. Mewn ymateb i amgylchiadau eithriadol pandemig COVID-19, estynnodd AGC hyn dros dro i 12 mis ar gyfer yr holl weithwyr newydd yn y gwasanaethau hyn. Gwnaeth AGC y penderfyniad hwn er mwyn cynorthwyo darparwyr i recriwtio a chadw staff ychwanegol pan oedd eu hangen fwyaf arnynt.

Mae AGC bellach yn bwriadu adfer y cyfnod o chwe mis ar gyfer cofrestru yn raddol o 1 Hydref 2022, a fydd yn cyd-fynd â'r dyddiad y bydd y gofyniad i weithwyr cartrefi gofal i oedolion gofrestru yn dod i rym.

Bydd y dull graddol hwn yn cynnwys y canlynol:

1. Bydd yn ofynnol i unrhyw staff newydd sy’n dechrau eu cyflogaeth mewn cartrefi gofal, llety diogel neu wasanaethau cymorth cartref rhwng 1 Hydref 2022 a 31 Mawrth 2023 gofrestru gyda Gofal Cymdeithasol Cymru erbyn 1 Hydref 2023.
2. Bydd yn ofynnol i unrhyw staff newydd sy’n dechrau eu cyflogaeth mewn cartrefi gofal, llety diogel neu wasanaethau cymorth cartref ar neu ar ôl 1 Ebrill 2023 gofrestru gyda Gofal Cymdeithasol Cymru o fewn chwe mis i’w dyddiad dechrau.

Newidiadau eraill

Byddwch yn ymwybodol bod Gofal Cymdeithasol Cymru yn ddiweddar wedi ymgynghori ar, ac yna cyflwyno, trefniadau newydd ar gyfer cofrestru i weithwyr gofal cymdeithasol. Mae’r newidiadau hyn yn cynnwys:

1. disodli’r llwybr Dyfarniad Egwyddorion a Gwerthoedd â model asesiad gan y cyflogwr wedi’i symleiddio, yn seiliedig ar gymwyseddau craidd

Faint o amser sydd gan weithwyr gofal i gofrestru?

Gallwch ddefnyddio'r tabl isod i benderfynu pryd y mae'n rhaid i weithwyr newydd gofrestru gyda Gofal Cymdeithasol Cymru:

Pa gamau y bydd AGC yn eu cymryd os bydd yn canfod yn ystod arolygiad nad yw staff wedi'u cofrestru o fewn chwe mis?

Bydd AGC yn disgwyl i bob darparwr weithredu yn unol â gofynion y rheoliadau. Pan nad yw'r darparwr yn bodloni'r gofynion cyfreithiol, bydd y camau a gymerwn yn gymesur, gan ystyried yr effaith neu'r risg i bobl sy'n defnyddio'r gwasanaeth a'r tebygolrwydd y bydd yn digwydd eto.

Registration of social care workers with Social Care Wales

Dear provider,

Currently, all care staff working in care homes for children, secure accommodation or domiciliary support services must register with Social Care Wales (SCW) within six months of the date they start employment.

This requirement will be extended to all adult care home workers in Wales from 1 October 2022.

New employees are given six months to become registered. However, in response to the exceptional circumstances of the COVID-19 pandemic, CIW temporarily extended this to 12 months for all new employees in these services. CIW took this decision to support providers to recruit and retain additional staff when they needed them most.

CIW now plan to re-instate the six-month period for registration in a phased way from 1 October 2022, aligning with the date the requirement for adult care home workers to register will come into force.

This phased approach will involve the following:

1. Any new staff who start employment in care homes, secure accommodation or domiciliary support services between 1 October 2022 and 31 March 2023 will be required to register with SCW by 1 October 2023.
2. Any new staff who start employment in care homes, secure accommodation or domiciliary support services on or after 1 April 2023 will be required to register with SCW within six months of their start date.

Other changes

You will be aware SCW has recently consulted on and introduced new arrangements for social care workers to register.  These changes include:

1. replacing the Principles and Values Award route with a simplified employer assessment model, based on core competencies
2. reducing the required number of hours of continuous professional development (CPD) in the three-year registration period for social care workers from 90 to 45 hours

These changes will make registration and CPD less onerous and more accessible for staff.

What does this mean for your service?

Why is CIW re-instating the six month period for social care workers to register with Social Care Wales?

What action will CIW take if during inspection, it finds staff are not registered within six months?

CIW will expect all providers to act in accordance with the requirements of the regulations.  Where the provider is not meeting the legal requirements, the types of action we take will be proportionate, taking into account the impact on or risk to people using the service and the likelihood of reoccurrence.
