Diweddariad ar ofynion datganiadau blynyddol
Annwyl ddarparwr,
Fe wnaethom ysgrifennu atoch ym mis Gorffennaf 2021 yn cadarnhau bod disgwyl i’r datganiad blynyddol llawn cyntaf gael ei gyflwyno ym mis Mai 2022. Yn ogystal, gwnaethom esbonio’r gofyniad i ddarparwyr gwasanaethau cofrestredig gyflwyno datganiadau blynyddol ar gyfer pob un o’r cyfnodau 2018-19, 2019-20 a 2020-21 (yn dibynnu ar y flwyddyn gofrestru).
Mae AGC a Llywodraeth Cymru yn ymwybodol bod darparwyr gwasanaethau yn dal i fod dan bwysau sylweddol oherwydd effaith y pandemig. Er mwyn cynorthwyo'r sector, bydd Llywodraeth Cymru yn cyflwyno rheoliadau i ohirio’r gofyniad am ddatganiad blynyddol tan fis Hydref 2022.
Yn ogystal, bydd y rheoliadau’n cyfyngu’r wybodaeth sydd ei hangen ar gyfer y datganiadau blynyddol sy’n ddyledus ym mis Hydref 2022 i’r hyn a nodir ar flaen Deddf 2016. Bydd y dull hwn yn lleihau faint o gynnwys sydd ei angen yn y datganiadau blynyddol yn sylweddol i'r canlynol:
- y gwasanaethau rheoleiddiedig y mae’r darparwr gwasanaeth wedi’i gofrestru i’w darparu;
- y mannau y mae'r darparwr wedi'i gofrestru i ddarparu'r gwasanaethau hynny ynddynt, ohonynt neu mewn perthynas â hwy;
- enw'r unigolyn cyfrifol sydd wedi'i benodi ar gyfer pob gwasanaeth;
- dyddiad cofrestru pob gwasanaeth a lleoliad rheoleiddiedig o'r fath;
- manylion unrhyw amodau eraill ar gofrestriad darparwr y gwasanaeth;
- manylion nifer y bobl y darparwyd gofal a chymorth iddynt gan y darparwr yn ystod y flwyddyn;
- datganiad sy’n nodi sut mae darparwr y gwasanaeth wedi cydymffurfio â gofynion y rheoliadau
Mae AGC wedi datblygu templed ar-lein a fydd yn rhaglenwi’r rhan fwyaf o’r wybodaeth hon, gan leihau’r baich ymhellach.
Byddwn yn ymgysylltu â chi ymhellach yn ystod y misoedd nesaf i egluro'r trefniadau ymarferol ar gyfer cyflwyno datganiadau blynyddol.

Update on annual returns requirement
Dear provider,
We wrote to you in July 2021 confirming the first full annual return was due to be submitted in May 2022. In addition we explained the requirement for registered service providers to submit annual returns to cover each of the periods 2018-19, 2019-20 and 2020-21 (depending on year of registration).
CIW and the Welsh Government are aware service providers are still under considerable pressure due to the impact of the pandemic. In order to support the sector, the Welsh Government will bring forward regulations to delay the requirement for an annual return until October 2022.
In addition, the regulations will limit the information required for the annual returns due in October 2022 to that which is set out on the face of 2016 Act. This approach will significantly reduce the amount of content required in the annual returns to:
- the regulated services the service provider is registered to provide;
- the places at, from or in relation to which the provider is registered to provide those services;
- the name of the responsible individual designated for each service;
- the date of registration for each such regulated service and place;
- details of any other conditions on the service provider’s registration;
- details of the number of people to whom the provider provided care and support during the year;
- a statement setting out how the service provider has complied with the requirements of the regulations
CIW has developed an online template which will pre populate the majority of this information, further reducing the burden.
We will engage with you further during the coming months to clarify the practical arrangements for the submission of annual returns.
