Diweddariad ar y gofyniad i gyflwyno datganiadau blynyddol

Gwnaethom ysgrifennu atoch ym mis Mawrth i gadarnhau y caiff datganiad blynyddol 2020/21 ei ohirio am flwyddyn arall tan fis Mai 2022. Ysgrifennwn atoch nawr i roi diweddariad pwysig arall i chi ar ddatganiadau blynyddol.

Rhagor o wybodaeth bwysig am ddatganiadau blynyddol

Yn ystod y broses o roi Deddf 2016 ar waith, gwnaed rheoliadau cychwynnol ar ddatganiadau blynyddol er mwyn nodi'r wybodaeth ychwanegol i'w chynnwys yn y datganiadau a'r dyddiad ar gyfer eu cyflwyno.

Bryd hynny, dealltwriaeth Llywodraeth Cymru ac AGC ill dwy oedd bod y dyddiad a bennwyd yn y rheoliadau yn cynrychioli'r dyddiad ar gyfer cyflwyno'r datganiad blynyddol cyntaf. Rydym wedi cael gwybod ers hynny fod y dehongliad hwn o Ddeddf 2016 yn anghywir. Mae Adran 10(1) o Ddeddf 2016 yn ei gwneud yn ofynnol i ddarparwyr gyflwyno datganiad blynyddol ar ddiwedd pob blwyddyn ariannol y mae'r darparwr wedi'i gofrestru ynddi. 

Sut mae hyn yn effeithio arnoch chi?

Mae hyn yn golygu y bydd yn ofynnol i ddarparwr pob gwasanaeth cofrestredig gyflwyno datganiad blynyddol llawn ym mis Mai 2022 ar gyfer blwyddyn ariannol 2021-22. Yn ogystal, bydd angen cyflwyno datganiadau blynyddol (ym mis Mai 2022) ar gyfer blynyddoedd ariannol 2018-19, 2019-20 a 2020-21 (yn dibynnu ar y flwyddyn gofrestru).  

Mae'n ddrwg gennym am hyn, ac am unrhyw anghyfleustra y bydd yn ei achosi i chi. Byddwn yn gwneud ein gorau i leihau'r baich arnoch fel darparwyr, gan sicrhau eich bod yn gallu cydymffurfio â'r ddeddfwriaeth ar yr un pryd.

Lleihau'r cynnwys sydd ei angen 

Cyflwynwyd rheoliadau i gyfyngu ar y wybodaeth sydd ei hangen ar gyfer datganiadau blynyddoedd blaenorol i'r hyn a nodir yn Neddf 2016. Bydd hyn yn lleihau'r wybodaeth y bydd angen ei chynnwys yn y datganiadau blynyddol ar gyfer y blynyddoedd ariannol blaenorol hyn yn sylweddol i'r canlynol:

  • y gwasanaethau rheoleiddiedig y mae darparwr y gwasanaeth wedi ei gofrestru i’w darparu;
  • y mannau y mae’r darparwr wedi'i gofrestru i ddarparu’r gwasanaethau hynny ynddynt, ohonynt neu mewn perthynas â hwy;
  • enw’r unigolyn cyfrifol dynodedig ar gyfer pob gwasanaeth;
  • dyddiad cofrestru pob cyfryw wasanaeth a man rheoleiddiedig;
  • manylion unrhyw amodau eraill ar gofrestriad darparwr y gwasanaeth;
  • manylion am nifer y bobl y rhoddodd y darparwr ofal a chymorth iddynt yn ystod y flwyddyn;
  • datganiad yn nodi sut mae darparwr y gwasanaeth wedi cydymffurfio â gofynion y rheoliadau

Mae AGC yn llunio templed a fydd yn rhaglenwi'r rhan fwyaf o'r wybodaeth hon, gan leihau'r baich ymhellach.

Byddwn yn cysylltu â chi eto yn ystod y misoedd nesaf i egluro'r trefniadau ymarferol ar gyfer cyflwyno datganiadau blynyddol ar gyfer blynyddoedd ariannol blaenorol.

Update on annual returns requirement

We wrote to you in March to confirm the 2020/21 annual return is being delayed again for a further year until May 2022. We are writing to you now to provide an important further update regarding annual returns.

Further important information regarding annual returns

During the implementation of the 2016 Act, initial annual returns regulations were made to set out the additional information to be included in the returns and the date by which they should be submitted.

At that time, the collective understanding in Welsh Government and CIW was that the date prescribed in the regulations represented the date on which the first annual return was due.  We have subsequently been advised this interpretation of the 2016 Act is incorrect.  Section 10(1) of the 2016 Act requires providers to submit an annual return following the end of each financial year during which the provider is registered. 

How this affects you

This means registered service providers will be required to submit a full annual return in May 2022 for the financial year 2021-22. In addition annual returns will be required (in May 2022) to cover each of the periods 2018-19, 2019-20 and 2020-21 (depending on year of registration).  

We regret this has happened and are sorry for the inconvenience this will cause you.  We will do our utmost to minimise the burden on you as providers whilst ensuring you are able to comply with the legislation. 

Reducing the content required  

Regulations have been brought forward to limit the information required for previous years’ returns to that which is set out on the face of 2016 Act.  This approach will significantly reduce the amount of content required in the annual returns for these previous financial years to:

  • the regulated services the service provider is registered to provide;
  • the places at, from or in relation to which the provider is registered to provide those services;
  • the name of the responsible individual designated for each service;
  • the date of registration for each such regulated service and place;
  • details of any other conditions on the service provider’s registration;
  • details of the number of people to whom the provider provided care and support during the year;
  • a statement setting out how the service provider has complied with the requirements of the regulations

CIW is developing a template which will pre populate the majority of this information further reducing the burden.

We will engage with you further during the coming months to clarify the practical arrangements for the submission of annual returns for previous financial years.
