Public Notice Updates

newspapers

The Texas Commission on Environmental Quality (TCEQ) is implementing new rule requirements in Title 30 Texas Administrative Code (TAC) Chapter 39 relating to public notice requirements. Additionally, TCEQ is in the process of implementing the Agency’s Language Access Plan and Public Participation Plan to meet requirements in Title VI of the Civil Rights Act.

This implementation impacts all permit applications subject to the Chapter 39 public notice requirements that are administratively complete on or after May 1, 2022. As a result of this implementation, the applicant must:

  • Provide Plain Language Summaries required as part of all applications subject to 30 TAC Chapter 39
  • Provide TCEQ with Alternative Language Translations of the Notice of Receipt and Intent to Obtain Permit (NORI), Notice of Application and Preliminary Decision (NAPD), and Plain Language Summary, if subject to alternative language requirements in 30 TAC § 39.426.

Detailed information for your specific permitting program may be found on the TCEQ Permits and Registrations webpage.

For more information about TCEQ’s efforts to comply with Title VI, visit the TCEQ Title VI Compliance webpage.
