ORDER TO TEMPORARILY CLOSE BEACH ACCESS ROADS
Beach access roads 4, 5, and 6 will be closed to vehicles due to projected storm surges along the Nueces County coastline

ORDER TO TEMPORARILY CLOSE
BEACH ACCESS ROADS
WHEREAS, on September 19, 2020 the Nueces County Judge through her under section 4 18.018 of the Texas Government Code declared a state of disaster for Nueces County, Topical Storm Beta posing a threat of imminent disaster, injury, or loss of life, property;
WHEREAS, Tropical Storm Beta is projected to cause storm surges along the Nueces County coastline;
WHEREAS, §418.017 of the Texas Government Code authorizes the Texas Governor to direct all necessary measures to be implemented to meet the threat posed by a disaster;
WHEREAS, as per section 418.1015 of the Texas Government Code these emergency powers of the Texas Governor are delegated to the county judge on an appropriate local scale; and
WHEREAS, Section 418.108(g) of the Texas Government Code that authorizes the county judge "to control ingress and egress to and from a disaster area and the movement of persons and the occupancy of premises in the area;" and
WHEREAS, the Nueces County Judge has determined that there is a need to protect against the loss of human life and property along the Nueces County coastline.
NOW THEREFORE, UNDER THE AUTHORITY OF TEXAS GOVERNMENT CODE SECTION 418.108, NUECES COUNTY JUDGE ORDERS:
Effective immediately and continuing until Tropical Storm Beta and its associated storm surge affecting the Nueces County coastline has dissipated:
1. Beach access roads 4, 5, and 6 will be closed to vehicles to the extent directed by barricades and signs.
2. The County of Nueces must promptly provide copies of this Order by posting on the Nueces County website.
3. Any peace office or other person with lawful authority is hereby authorized to enforce the provisions of this Order in accordance with the authority granted under the Texas Disaster Act of 1975 and the Nueces County Emergency Management Plan.
