Proposed Rule Changes in 40 TAC Chapters 744, 745, 746, and 747

The purpose of this e-mail is to engage permit holders and other interested parties in the CCL rule development process by:

•  informing stakeholders of proposed rule amendments and proposed new rules;

•  providing stakeholders with information on where to view the rule changes that were proposed to the DFPS Council on October 18, 2013 (Items 6d and 6f); and

•  requesting feedback and comments on proposed rules from stakeholders. 

 

On October 18, the DFPS Council approved the following amendments for posting in the Texas Register for public comment:

     • 40 TAC Chapter 744 (Minimum Standards for School-Age and Before or After-School

     Programs):

•  §744.901 (in Subchapter C, Record Keeping)

     • 40 TAC Chapter 745 (Licensing):

•  §§745.601, 745.625, 745.651, 745.686, and 745.697 (in Subchapter F, Background Checks)

•  §§745.8481, 745.8485, 745.8487, 745.8491, and 745.8493 (in Subchapter K, Inspections and Investigations)

•  §745.8711 (in Subchapter L, Remedial Actions)

     • 40 TAC Chapter 746 (Minimum Standards for Child-Care Centers):

•  §§746.801 and 746. 901 (in Subchapter C, Record Keeping)

     • 40 TAC Chapter 747 (Minimum Standards for Child-Care Homes):

•  §747.901 (in Subchapter C, Record Keeping)

 

On October 18, the DFPS Council approved the new rules for posting in the Texas Register for public comment:

     • 40 TAC Chapter 745 (Licensing):

•  §§745.603, 745.615, and 745.630 (to be in Subchapter F, Background Checks)

•  §745.8495 (to be in Subchapter K, Inspections and Investigations)

•  §§745.8713 and 745.8715 (to be in Subchapter L, Remedial Actions)

     • 40 TAC Chapter 746 (Minimum Standards for Child-Care Centers):

•  §§746. 5623, 746.5625, and 746.5627 (to be in Subchapter X, Transportation)

 

 

The proposed rules will be published in the Texas Register on November 15, 2013, and public comment will be taken from November 15, 2013 to December 16, 2013.
