Expiring Emergency Rules for Hospital and Psychiatric Hospital Visitor Screening and Access in Response to COVID-19

The following emergency rules, concerning hospital and private psychiatric hospital visitor screening and access, expire on March 23, 2021:

  • §133.51, Visitor Screening and Access During the COVID-19 Pandemic, in Texas Administrative Code Title 25 (25 TAC), Part 1, Chapter 133, and
  • §510.48, Visitor Screening and Access During the COVID-19 Pandemic, in Texas Administrative Code Title 26 (26 TAC), Part 1, Chapter 510, Subchapter C.

Effective March 24, 2021, hospitals and psychiatric hospitals are no longer required by emergency rule to screen visitors for COVID-19 and restrict visitor access. Hospitals licensed under Health and Safety Code (HSC) Chapter 241 and private psychiatric hospitals licensed under HSC Chapter 577 are still required by standard rule to:

  • Provide a sanitary environment to avoid sources and transmission of infections and communicable diseases; and
  • Ensure policies governing prevention, control and surveillance of infections and communicable diseases are developed, implemented and enforced.
