October 2017 Salvage/Nonrepairable Motor Vehicle Manual Update

The latest update to the Salvage/Nonrepairable Motor Vehicle Manual (attached) is now available via Registration and Title System workstations and at www.txdmv.gov.

Updates for this release are marked with red change bars in the text. 

The majority of the manual revisions include changes from the 85th Legislative Session and Registration and Title Bulletin (RTB) #006-17.  The following are brief summaries of the chapters updated in the October 2017 revision.

Chapter 1 – General
Section 1.1, “Definitions,” was updated as a result of Senate Bill 2076, which expanded the definition of a nonrepairable motor vehicle.

Chapter 2 – Title Application and Issuance
Section 2.4, “Application for Salvage or Nonrepairable Vehicle Title,” was updated to be consistent with the Application for Salvage or Nonrepairable Vehicle Title (Form VTR-441).

Section 2.6, “Proof of Sales Tax Payment Required,” was updated to provide instructions on the two processes available for the insured to obtain title in their name when a motor vehicle has been in an accident and is not in the insured’s name.

Section 2.8, “Certificate of Authority to Demolish a Motor Vehicle,” was updated as a result of House Bill (HB) 3131, which provided updates to the application process for a Certificate of Authority.

Chapter 4 – Insurance Companies
Section 4.4, “Owner Retained Vehicles,” was updated to clarify an owner of a salvage or nonrepairable motor vehicle may not transfer ownership of the motor vehicle unless the department has issued a salvage/nonrepairable vehicle title, salvage/nonrepairable record of title, or comparable ownership document issued by another state or jurisdiction in the name of the owner.

Chapter 7 – Owners and Other Entities
Section 7.3, “Owners Wishing to Dispose of Motor Vehicles,” was added to include updates resulting from HB 3131, which updated the process for an individual to dispose of a motor vehicle to a motor vehicle demolisher.  All subsequent sections were renumbered.  

Chapter 9 – Forms, References, and Q&As
Section 9.5, “Questions and Answers,” was updated as a result of RTB #006-17, which established that an insurance company may not reassign a Texas title document and must obtain title in their name prior to any subsequent transfer.
