Vendor Performance Tracking System

Notice regarding Vendor Performance Reminders:

The 83rd Legislative Session passed Senate Bill 1681. This bill includes Section 2262.055 addressing the Vendor Performance Tracking System. The statute requires state agencies to report vendor performance pursuant to criteria established by the Comptroller of Public Accounts. The criteria are:

  • Per 34 Texas Administrative Code §20.108, “State agencies shall report a vendor's performance on any purchase of $25,000 or more from contracts administered” by TPASS or any other purchase made through an agency's delegated authority or a purchase made pursuant to the authority in the Government Code or a purchase exempt from TPASS’ procurement rules and procedures.
  • Vendor Performance Reports should be entered within 60 days of incident occurrence or completion of contract.
  • Incidents entered more than 90 days after occurrence will be filed, but not acted upon unless TPASS determines actions are significant enough to warrant it.
  • Late deliveries between six and 15 days will be finalized with no “unsatisfactory” codes if goods are received and are acceptable. Code 005 Late Delivery may be used, but not 201 Late Delivery, which is a resolution code which can impact the vendor’s score.

Failure to enter this information into the Vendor Performance Tracking System may result in an audit finding.
