TPASS Term Contract Updates

The following message is to address an issue regarding contractor quotes on TPASS contracts:

TPASS contracts are procured using the Request for Proposal (RFP) method which allows the state and contractors to negotiate terms and conditions during the procurement process. However, once the contract has been awarded, the terms and conditions of this contract may be modified only through a written amendment executed by an authorized representative of the Comptroller of Public Accounts (CPA). Customer agency employees may not modify the terms and conditions nor amend the contract even with a written approval. Furthermore, a vendor cannot amend the contract after it has been awarded.

As stated in most Notices of Award, any assumptions or exceptions not specifically noted in the Notice of Award letter or the attachments to the Notice of Award are specifically denied. Furthermore, any oral accommodations to grant Respondent’s assumptions or exceptions are specifically disclaimed. Should a vendor try to inappropriately amend the contract (i.e., by attaching additional terms and conditions to contractor quotes or purchase orders), please direct them to the Notice of Award and B.3.2 of the RFP which prohibits such improper attempts to amend the contract absent authorization from a CPA representative.
